Mandate to collate and assign to John Finlarii (sic), priest, of the diocese of Argyll, who was lately dispensed by papal authority, as the son of a monk priest, professed of the Cistercian order, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, the canonry and prebend of St. Constantine sive Cyllenfultan in Argyll, which are of lay gift, value not exceeding 6 marks sterling, so long void, by the death of Odo [son] of Odo Macidh, that their collation lapsed to the apostolic see, summoning and removing Colin [son] of John Macmagistir, priest, of the said diocese, who has unduly detained possession for more than six years under pretext of a collation made to him by authority of the ordinary after the said lapse; notwithstanding that the pope lately [below, f. 176] ordered provision to be made to him of the perpetual vicarage of Kilcalmonell (Sancti Colmanelii) in the said diocese, value not exceeding 10 marks sterling. Mandate—the pope having been informed by Donald Magranaill, clerk, of the diocese of Ardagh, that John Ofergaill, rector of the rectory of a number of churches, even parish churches, called the rectory of Montereolais in the said diocese, is a public concubinary, and has been guilty of dilapidation, of perjury, and of homicide against the late Cornelius Magerrai, layman—if Donald, who on account of John's power has no hope of obtaining justice in the city or diocese of Ardagh, will accuse John before him, to summon John and others concerned, and if he find the above, or enough thereof to be true, to deprive John, and in that event to collate and assign the said rectory, value not exceeding 16 marks, to Donald, who has been dispensed by papal authority, as the son of unmarried parents related in the fourth degree of kindred and the fourth of affinity, to be promoted to minor orders, after which he had himself made a clerk. To the provost of Lynclwdene in the diocese of Glasgow. Mandate as below. The recent petition of Alexander de Kynglassy, priest, of the diocese of Dunkeld, contained that formerly Alexander, bishop of Whiteherne, imposed on William de Kyrcaldy, perpetual vicar of Anwyth in the diocese of Whiteherne (who for many years had been infirm and unable to serve the said church in person, and was therefore absent about sixty miles of those parts amongst his relatives and friends) a too short time within which to go to the said church and serve it, and on his failing to do so deprived him, notwithstanding that the said church was being served by a fit priest in his name, and collated it, as being thereby void, to Stephen Forest, priest, who under pretext thereof is still unduly in possession, from which deprivation and collation the said William, as soon as he heard thereof, appealed to the apostolic see, but, on account of his bodily weakness and dislike of litigation, has not yet pursued (intentavit) the appeal, although he is still within the lawful time. Seeing that the said William has this day resigned to the pope the said vicarage and all right in or to it, and that the pope has admitted the resignation, the pope orders the above provost, seeing that by reason of the said bishop's inordinate favour towards the said Stephen, his chaplain and a continual member of his household, and on account of Stephen's power, the said Alexander has no hope of obtaining justice in the city or diocese of Whiteherne, to summon Stephen and others concerned, and if he find that the said deprivation was without reasonable cause, to annul it and the said collation, and in that event, and if he find fit the said Alexander (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) to collate and assign to him the said vicarage, value not exceeding 10 marks sterling. Mandate to collate and assign to Isaac Omygir, priest, of the diocese of Killaloe, who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, the perpetual vicarage of Druymcleyb in the said diocese, value not exceeding 8 marks, which became void and reserved to the late Baldassar, bishop of Tusculum, called John XXIII, because Thady Omygir, when holding it, obtained by authority of letters of the said bishop the rectory of the same church, and, obedience having been withdrawn from the said bishop before he had disposed thereof, remained reserved to Martin V and, he likewise not having disposed thereof, remains void and reserved to the present pope; summoning and removing the said Thady, who is a priest, and who has, without any dispensation, detained the said vicarage and rectory together for more than eight years.   • 3. This date is not consistent with the date of the provision to bishop Peter in Eubel, Hierarchia, under ‘Clochoren.’, Viz. 1433, Aug. 31. Vol. 66 of the Obligationes, f. 3, to which Eubel refers has, however, as the date of the provision iii. Idus Julii, i.e. July 13, which fits in with the above Prid. Kal. Aug. i.e July 31.
