To Master Geminianus de Prato, papal chaplain and auditor. Mandate as below. A suit arose between Richard Pellyn, canon of Lismore, and John Corr alias Garot, priest, of the diocese of Cork, about the perpetual vicarage of Kynsalle in the said diocese, which became void by the deprivation for his demerits of the said John by Richard, archbishop of Cashel, by his authority as metropolitan, and which Richard claimed under collation and provision by the ordinary, which collation and provision John opposed, preventing them from taking effect. The cause, although not devolved by its nature to the Roman court, was committed by Baldassar, called John XXIII, at Richard's instance, to the above auditor, who proceeded short of a conclusion, and upon its being alleged that neither Richard nor John had any right, the same pope ordered the auditor, on 18 Kal. Jan. anno 5 [1414], if this proved to be the case, to collate and assign the vicarage, value not exceeding 40 marks, to Richard; notwithstanding that Richard held the deanery of Cork, a major dignity, value not exceeding 8 marks, and canonries and prebends of Lismore and Emly, value not exceeding 7 marks, requiring him, upon obtaining the said vicarage, to resign the said deanery. In pursuance of the said mandate, the letters of which were not drawn up while those parts were of the obedience of pope John, the pope hereby orders the auditor, if it prove that neither of the litigants has a right, to collate and assign the vicarage to Richard. To the bishop of Ciudad Rodrigo, and the abbots of Trym and Navan in the diocese of Meath. Mandate to collate and assign to Robert Sutton, canon of Dublin, the still void archdeaconry of Kenlys in Meath, a non-major dignity, value not exceeding 100 marks, which, on its voidance by the death of Adam le Nase, Robert obtained by collation and provision made under letters of Baldassar, called John XXIII, by which he had expectation of one or two benefices, even if such one or one of such two had cure or were a dignity etc., in the common or several gift of the archbishop of Dublin and the bishop of Meath, in the gift of which latter is the said archdeaconry. He doubts whether the said collation and provision hold good. The present collation is to be made notwithstanding that Robert (who, when holding the parish church of Slane in the diocese of Meath, was dispensed by papal authority to hold therewith for life one other benefice with cure or otherwise incompatible, and to resign both, for exchange or otherwise, as often as he pleased) holds the said church of Slane and the canonry and prebend of Howth in Dublin, value not exceeding 120 marks. To the abbot of Mayo in the diocese of Tuam, and the provost of Achonry. Mandate as below. The recent petition of Murianus Ygamnan, canon of Tuam, contained that archbishop John, seeing that the fruits, not exceeding in value about a mark and a half, of the prebends of Kyllmygany, Cluaynmor and Kyllcurrnan (which were wont to be assigned, sometimes to one canon as a single prebend, and sometimes to more than one canon as separate prebends), were, on their becoming void by Cornelius Okeallayd, sometime canon of Tuam, obtaining by collation of the ordinary another prebend of Tuam, called Nakeallineg, unduly held possession of by certain persons; and that the perpetual vicarages of Croysbuythyn, Cluaynmor and Kyllcurrnan could be governed and the cure of their parishioners exercised by the perpetual vicar for the time being of Croysbuythyn, ordained that the said prebends should be a single prebend under the name of Kyllmygany, and that the said vicarages should be governed as above, and their parishioners go for mass etc. to the church of Croysbuythyn as their parish church. He further appropriated and united to the said prebend of Kyllmygany (which he collated and made provision of to the above Murianus, whom he had already admitted as a canon of Tuam) the above perpetual vicarages and those of Balla in the diocese of Tuam, formerly Mayo, and Duloch in the diocese of Tuam, and the parish church called the custodia of the Relics of St. Hyerlatheus, commonly called Tempullnascriny, in the diocese of Tuam, value altogether not exceeding 23 marks. At the said petition, which adds that it is asserted that the said prebends, united and made one as above, and vicarages and the church called the custodia had been so long void at the time of the said unions etc. that the collation of them had by the Lateran statutes lapsed to the apostolic see, the pope orders the above two, if they find the facts to be as stated, to confirm the archbishop's proceedings, and to again collate and assign the said prebend of Kyllmygany, with its said annexes, to Murianus; notwithstanding that the pope has this day ordered provision to be made to him of the rectories of Raythcurrnan and Balymgarrga in the said diocese of Tuam, formerly of Mayo, value not exceeding 10 marks, with suppression of the cure of souls therein (see below). To the abbot of Boyle (de Buellio) in the diocese of Elphin and William Ofloyun, canon of Tuam. Mandate as below. The recent petition of the above Murianus contained that the above archbishop John, on the voidance of the rectories, of the patronage of laymen, of Raythcurrnan and Balymgarrga in the diocese of Tuam, formerly of Mayo, because their respective rectors Thady Oconcurbair and Elias (Helyas) Macmic (this word is added in the margin) Helyas Prindragas had held them for more than a year without having themselves ordained priests and without having dispensation super hoc,, seeing that the said rectories had but little cure of souls, suppressed it and transferred it to the perpetual vicars or chaplains or ministers of the churches of Kyllmygany and Crosbuythyn respectively, likewise in the diocese of Tuam, formerly of Mayo. At the same time he made collation and provision to Murianus of the said rectories, value not exceeding 10 marks, thus void, and so long void, as some asserted, that the collation of them had by the Lateran statutes lapsed to the archbishop. At the said petition, which adds that it is asserted that the rectories had, at the time of the said collations and provisions, been so long void that by the said statutes their collation had lapsed to the apostolic see, the pope orders the above two, if they find the facts to be as stated, to confirm the archbishop's proceedings, and to collate and assign the said rectories to Murianus, notwithstanding that the pope has this day ordered provision to. be made to him of the prebend of Kyllmygany in Tuam with its annexes, value not exceeding 24½ marks, and that he was lately admitted by authority of the ordinary as a canon of Tuam. To Solomon Obrolcham, rector of Cluynchaka in the diocese of Derry. Rehabilitation on account of the following. Baldassar, called John XXIII, on learning that the above rectory was void because David Omurgisan had obtained and held with it for more than a month the rectory of Cluynmani in the same diocese against ‘Execrabilis,’ ordered it to be collated and assigned to Solomon, who had had papal dispensation, as the son of a priest, O.S.A., and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure. After obtaining possession under the said mandate, he was obliged to give to Luke Om[o]lmochchair, clerk, of the said diocese, who opposed his possession, a moiety of the fruits, less two ducats. It is further asserted that the said rectory (which has under it divers chapels with perpetual vicars) is called a plebania and is wont to be governed by canons of Derry, no mention of which was made in the said mandate, and that it became void otherwise than as stated above. The pope decrees that Solomon is not bound to give the said moiety, rehabilitates him, and grants that the said mandate shall have force from the present date, notwithstanding the said omission. To the bishop of Ardagh. Mandate as below. The recent petition of John Magillavanem, clerk, of the diocese of Ardagh, contained that for more than the last thirty years the deans of Ardagh, in pursuance of an union made to the deanery (which is a major dignity and of which, about to become void, the pope has ordered provision to be made to the said John) by authority of the ordinary of the perpetual vicarage of Gleand in the said diocese, have taken the fruits etc. thereof, the parish church itself being devoid of parishioners on account of wars, etc. At the said petition—which added that John is unable to guarantee (fidem facere) whether the said union was temporary or perpetual, and that the fruits etc. of the deanery are insufficient for the maintenance of the dean and his expenses for hospitality etc.—the pope hereby orders the above bishop, if he find the facts to be as stated, to appropriate and unite in perpetuity the said vicarage to the deanery, value not exceeding 6 and 20 marks respectively. To the bishop of Arezzo (Aretin.), the dean of Killaloe and the treasurer of Kilmacduagh. Mandate to collate and assign to Denis Odonchuga, priest, of the diocese of Kilmacduagh (who lately received papal dispensation, as the son of an unmarried man and an unmarried woman related in the third and fourth degrees of kindred, to be promoted etc.as above, f. 102), the still void rectory, value not exceeding 8 [cf. above, p. 90] marks, of Clecealle alias Kynaledga Hieratrach in the said diocese, to which, on its voidance by the resignation of Nemeas Ymycherayn to bishop Eugenius, he was presented by the patron Walter de Burgo, and instituted by the said bishop. He doubts whether the presentation and institution hold good. The collation is to be made whether the rectory became void as above, or by the non-promotion [to the priesthood] of John Mecleyn, or in any other way. Vite etc. (Franciscus. xxii. Tercio Kal. To the bishop of Sessa (Suessan.), the archdeacon of Killaloe, and Donald Oscannlayn, canon of Ardfert. Mandate to collate and assign to Roderick Ogyllascanayn, priest, of the diocese of Killaloe (who has had dispensation from the ordinary, as the son of a priest and an unmarried woman, to have the tonsure, and, after having received the tonsure, papal dispensation to be promoted to all minor and major orders and hold a benefice with or without cure), the perpetual vicarage of Kyllfreborach in the said diocese, value not exceeding 12 marks, which on its voidance (because Cornelius Oloyngsyg had held it for more than a year without having himself ordained priest and without dispensation super hoc) Roderick obtained under papal collation and provision, and has held it, though not peaceably, for more than a year without having himself ordained priest, on account of an impediment, wherefore he doubts whether it be not still void as above. To James, elect of Penna. Mandate as below, James Symond, rector of St. Mary's, Kildalk, in the diocese of Meath, set forth to Baldassar, called John XXIII, that a suit had arisen between himself and the late Maurice Obeyn, clerk, about the archdeaconry of Glendalough (Glyndelacen.) in Dublin, a non-major dignity with cure, value not exceeding 50 marks, on the voidance of which by papal provision being made to Thomas, now bishop of Ossory, of the see of Lismore, James claimed that provision was made to him by papal authority; that at the instance of James, the late Angelus, then called Gregory XII, committed the cause, although not devolved by its nature to the Roman court, to the late Jerome de Sydenbergh, papal chaplain and auditor, and that afterwards John XXIII committed it to the above bishop, then a papal chaplain and auditor, whilst the suit was pending before whom Maurice died; that the same pope John, upon the expected voidance of all right possessed in or to the archdeaconry by Donald, elect of Derry (who claimed to have had provision of it by papal authority, and was in possession), by the provision made to him by the said pope of the said see, and by his then approaching consecration, ordered the above bishop, on 7 Kal. March anno 5 [1415], to surrogate James to whatever right the above Maurice had possessed at the time of his death etc., and to collate and assign to him the archdeaconry itself; notwithstanding that James had had papal dispensation to hold for life any two benefices with cure or otherwise incompatible, and resign them as often as he pleased, simply or for exchange, and that he held the above parish church, value not exceeding 60 marks. The pope hereby decrees that the said mandate of John XXIII shall take effect from the said date, notwithstanding that the letters thereof were not drawn up during his obedience in the said parts, and that the present letters shall suffice as proof thereof; and orders the above bishop, who still holds by the pope's order the place of an auditor, to execute it.
