Mandate touching the complaint of Master Anthony de Laveza, chaplain of Luke, cardinal of St. Mary's in Via Lata. Anthony states that provision had been made to him by apostolic authority of a canonry and prebend of Wells; that he designated Francis his brother, proctor, and Master B. archdeacon of Exeter, sub-delegate of the executor granted to him by the apostolic see in this matter; that the said sub-delegate and proctor published the processes in the said church of Wells when they could not have leave of the chapter; that Thomas de Gorges, precentor, Robert de Haselscaue, then chancellor, Thomas, his brother, Hugh de Penittis, Richard de Pistok, William de Serleton, Thomas de Logor, canons of the said church, Richard called ‘Parisius,’ rector of the church of Torteworth, in the diocese of Worcester, and Thomas Springose, clerk, nephew of Walter, bishop of Bath and Wells, by order, as is believed, of the said bishop (who is said to have asserted that he did not believe that the pope would make provision to anyone in his church), going to the house in which the subdelegate and proctor, and their servants were, made an attack upon them, dragged them through the city of Wells, and shut them up in the bishop's prison; that they kept in prison for some time the proctor and one of his servants, without food or drink or medical care, the malefactors themselves bringing a false accusation against them, carried them on two beasts to the king's prison that they might be handed over to the gallows, which would have been done had not their innocence been proclaimed; moreover, that Benedict, the sub-delegate's nephew, who was with the sub-delegate and proctor, died of his wounds, and, although the proctor and his servant were acquitted by the king's justiciary, by the malice of the bishop and his party they were detained for nine months and more, nor could they leave the bishop's prison without giving him a caution that they would present themselves before the justiciary, and that the bishop and his party should have no punishment from the apostolic see for their excesses, and that no complaint should be laid against them; these and many other things omitted for the sake of brevity are said to have been perpetrated by those malefactors; moreover, the bishop, dean, and chapter, appealing from the processes of the executor, Onuphrius de Trevis, dean of Melton, papal chaplain, was appointed special auditor. The said bishop, dean, chapter, precentor, chancellor, canons, rector, and clerk, and also Richard de Abendonia, unlawful detainer of the said prebend, are now cited to appear before the pope within nine months, the dean and chapter to appear by proctor, the others in person.
