Bullarum Communium Lib. LVII. Tom. LXII.
10 Sixtus IV.
1480[–1]. 4 Id. Feb. (10 Feb.) St. Peter's, Rome. (f. 183v.) |
To the dean and the archdeacon of Cashel, and Edmund Marreis, a canon of the same. Mandate, as below. The pope has been informed by Richard Euerartd, clerk, of the diocese of Cashel, that Thomas Omleluchi. a canon of Cashel, paid Maurice Vacenstin, priest, of the diocese of Lismore, who alleged that he had a right in a canonry of Cashel and the prebend of Rathull’ [sic] therein, a sum of money in order that he should put Thomas into possession, Thomas thereby committing simony, and that he has allowed the buildings of the parish church of Rathcoll’ [sic] in which is the said prebend, to fall into ruin. The pope has also learned that the perpetual vicarages of Kilmelath and Kylmeklay, and also that of Crompiston, in the said diocese [of Cashel], have been void so long that there is no certain knowledge of the mode of their voidance, and that their collation has lapsed to the apostolic see. He therefore hereby orders the above three, if Richard, who is by both parents of noble birth, will accuse Thomas before them, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value 6 marks sterling, to Richard; to unite the said vicarages, of which two are without cure and one has a small cure (the fruits of which vicarages, value 6 marks sterling, the archbishop of Cashel receives because no provision has yet been made of them) to the said canonry and prebend for Richard's lifetime only, transfer the cure of the said prebend to the said church of Cashel, and ordain that the said prebend shall henceforward for Richard's lifetime not be a sacerdotal prebend, and that he shall not be bound on account of it to be promoted to priest's or any other holy order, but may have the said church of Ratholl’ served by a fit priest. Romanum decet pontificem. (In the margin: Februarii.) [7¼ pp.] |

Kal. March. (1 March.) St. Peter's, Rome. (f. 198v.) |
To the provost of Elphin, and Carbricus and William Oberrim, (fn. 1) canons of the same. Mandate, as below. The pope has learned that the rectory of the rural place or land of Munnteroleys in the diocese of Ardagh, of lay patronage, has been so long void that its collation has lapsed to the apostolic see, although Donald Offergail, clerk, has held possession of it for between sixteen and twenty-eight years without any canonical title. The recent petition of Cornelius (who alleges that he was lately, under a dispensation granted by papal authority on account of illegitimacy as the son of a Friar Preacher and an unmarried woman, promoted to all holy orders) contained that he obtained under a papal mandate of provision the perpetual vicarage of Kylltacunich (fn. 2) in the said diocese, to which a certain other vicarage in the said diocese is annexed, and that he holds it at present; that he was recently, when coming to the Roman court, compelled by the said Donald to swear not to molest him in regard to his benefices; and that the value of the vicarage of Kylltacunich (the cure of which is wont to be exercised by perpetual vicars), and its said annexed vicarage, and that of the said rectory, do not exceed 8 and 24 marks sterling, respectively. The pope, therefore, hereby relaxes the said oath, and orders the above three to summon the said Donald, and if they find the facts to be as stated, to unite the said rectory to the vicarage of Kylltacunich for the lifetime of Cornelius. Ex apostolica nobis. (In the margin: Mar.) [4 pp.] |
3 Kal. Feb. (30 Jan.) St. Peter's, Rome. (f. 207v.) |
To the dean and the precentor of Emly, and Karolus Macbrien, canon of the same. Mandate, as below. The pope has learned that the rectory of Desertethuy (fn. 3)alias Balegybun, of lay patronage, and a parcel of tithes of Balialy, situate within the bounds of the parish churches of Killmoyr and Dolud, in the diocese of Killaloe (Laonien.), wont to be assigned as a title of a perpetual benefice to secular clerks, have been void so long that there is no certain knowledge of the mode of their voidance, and that their collation has lapsed to the apostolic see, although Donald Okennidig, priest, of the said diocese, and the rector or locum tenens of the said parish church of Kyllmoyr have, without any canonical titles, detained the said rectory and parcel, for about a year and for some time, respectively. The pope, therefore, hereby orders the above three to collate and assign to Philip Okennedyg, clerk, of the said diocese, who has no hope of obtaining justice in the city or diocese of Killaloe, the said rectory and parcel, with and without cure, and value 5 and 2 marks sterling, respectively, summoning and removing the said Donald and rector. Vite etc. (In the margin: Februarii.) [3 pp.] |
