To the treasurer of Holy Trinity, Waterford. Mandate, as below. The pope has been informed by Thomas Corr, priest, of the diocese of Waterford, that in the course of litigation between Thady, bishop of Down and Connor, and the late Patrick Cantwel, then a canon of the monastery of St. Mary the Virgin, Cathir, O.S.A., in the diocese of Lismore, about the priory of St. Catherine's by (juxta) Waterford, O.S.A., the latter obtained a definitive sentence in his favour, after which, in order to avoid further litigation, they agreed, after certain simoniacal bargains between them, that Patrick should remain in possession; that William Winchedon, now prior of the same, in the course of litigation with the said bishop and Patrick, gained a definitive sentence against the latter, after which he and Patrick made in like manner a simoniacal agreement by which William remained in possession, after and in spite of which the said bishop molested Patrick, as long as he lived, and continues to molest William, to the injury and threatened total ruin of the said priory. The pope therefore hereby orders the above treasurer, if Thomas will accuse the said bishop and William before him, to summon them, and if he find the foregoing to be true, to deprive and remove them, and in that event to cause Thomas to be received as a canon of the said priory and the regular habit to be given to him, and receive his profession, and thereupon to collate and assign to him the said priory, conventual, elective and with cure, value not exceeding 70 marks sterling. Motu proprio statute and ordinance, as below. The pope has learned that a number of abbots, priors and provosts of the Order of St. Benedict in England, not only by title of exemption, but also under pretext of the names of Cluniac, Holy Trinity or La Charité, etc., refuse to attend the provincial chapter and to be visited and corrected by the presidents thereof, etc., wherefore many goods of the non-visited monasteries etc. of the said Black Monks are alienated and fall into the hands of temporal lords and other laymen. The pope therefore hereby ordains that in future all the said abbots, etc., by whatsoever name they be called, shall be subject to the provincial chapter and its presidents, that they and their monasteries etc. shall be visited, corrected and reformed by the said presidents or their deputies, and that the said monasteries etc. and their goods shall be protected by the said chapter and presidents against those who attempt to possess themselves thereof, etc.; with inhibition of such attempts, under pain of eo ipso sentence of excommunication, etc. Ad perp. rei mem.
