To the archpriest of Dromore, Donald Macgum (recte Macginn), a canon of the same, and the official of the same. Mandate, as below. The pope has learned that the monastery of Newry (de Viridiligno), O Cist., in the diocese of Dromore, has been so long void by the death of abbot Magonius extra R.c. that its provision has lapsed to the apostolic see, although John Macgillanei (?), (fn. 2) who is a clerk, and is illegitimate, being the son of a priest and an unmarried woman, and who is to be summoned and removed, has detained possession for between eighteen and twenty years without any dispensation, under pretext of a de facto provision made by the then abbot of Mellifont, of the said order, in the diocese of Meath (Melden, recte Miden.), who alleged that the provision belonged to him; and the pope has this day by other letters ordered the above three to cause Maurice Macbrain (?), clerk, of the said diocese of Dromore, to be received as a monk of the said monastery of Newry (de Viridiligno) and the regular habit to be given to him, and to receive his profession. The pope now hereby orders them to make to the said Maurice, (who has been made a clerk, notwithstanding his illegitimacy as the son of an abbot of the said order and an unmarried woman), after he has made his said profession, provision of the said monastery, value not exceeding 25 marks sterling. The pope further dispenses him to be abbot and to exercise the rule and administration, notwithstanding the said defect, etc., and grants that he may be blessed by any catholic bishop of his choice in communion with the said see. Mandate to collate and assign to Nicholas Onary, clerk, of the diocese of Tuam, the perpetual vicarage of the parish church of Kiltulhach in the said diocese, value not exceeding 4 marks sterling, so long void that there is no certain knowledge of the last mode of its voidance, and that its collation has lapsed to the apostolic see, although James Ohelhuytd (?), (fn. 3) priest, of the said diocese, who is to be summoned and removed, has under pretext of a collation by the ordinary detained possession for between six months and a year; whether it be void by the death of Bernard Yolayn extra R.c., or by his resignation or that of Thomas Ygonam, or be void in any other way. To the dean of Killaloe (Launen., recte Laonien.). Mandate, as below. The recent petition of Nicholas Ofathi, perpetual vicar of the parish church of Kilcroner in the diocese of Clonfert, contained that although the deanery of Clonfert has abundant rents etc., (fn. 4) nevertheless Carbricus Machkan, the present dean, holds, as united thereto by authority of the ordinary, certain parcels or annual rents, viz. of the places of Druymimchyhit, [Killculy,] Killenlyninduna, (fn. 5) Ballenacylli, Tulach [and] Micrusclaymi [sic], in the said diocese, which were lately wont to be collated as a title of perpetual benefices to secular clerks, the separation of which parcels from the said deanery, and the erection therewith of a canonry and prebend in the said church of Clonfert would be to the increase of divine worship in the said church etc., whilst the said dean could well maintain himself with the other rents etc. of the deanery. The pope, therefore, hereby orders the above dean of Killaloe to summon the said Carbricus (from fear of whose power the said Nicholas cannot safely meet him within the city and diocese of Clonfert (fn. 6) ), and others concerned, and if he find the foregoing to be true, to erect a canonry and prebend in the said church, separate from the said deanery the said parcels of Druymimchiit, Killculy, Killihumuduna, Ballena[c]ylly, Tullach [and] Micunsclaymi [sic], and unite them in perpetuity to the said canonry and prebend, under the name of the prebend of Druymimchiyt, and in the event of their so doing, to collate and assign the said canonry and prebend, value not exceeding 8 marks sterling, to the said Nicholas, whom Calixtus III dispensed, notwithstanding his illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and receive and retain the perpetual vicarage of the parish church of Killeruimthie [recte Killcruimchyr] alias Kineclechyn in the said diocese, provision of which the said pope had ordered to be made to him [Cal. Papal Lett. XI, pp. 213–4], in virtue of which dispensation he had himself so promoted, and obtained and still holds the said vicarage, value not exceeding 10 marks sterling. Peter and Paul, Armagh, O.S.A., and give him the habit, or to cause him to be so received and the habit given to him, and receive his profession. He is in due course to resign all his benefices, except the deanery of Derry (Daren. recte Deren.), which, about to become void in a certain way, the pope has this day ordered to be granted to him in commendam. To James Okylty, a canon of Armagh. Mandate, as below. The pope has been informed by Thomas M[a]ckamyll, a canon of Derry (Daren. recte Deren.), that Thomas, abbot of the monastery of SS. Peter and Paul, Armagh, O.S.A., has dilapidated its immoveable goods and precious moveable goods, and has allowed its roof and walls to become ruinous and divine worship therein to be diminished. The pope therefore (who has this day ordered, as in the preceding), hereby orders the above canon, if the said Thomas, who is of noble birth, will accuse the said abbot before him, to summon the latter, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision of the said monastery, value not exceeding 70 marks sterling, to Thomas. The pope further grants that until he obtains possession of the rule and administration he is not bound to make the said profession and take the said habit, and also grants him indult to be blessed by any catholic bishop of his choice in communion with the apostolic see, without prejudice to the archbishop of Armagh. To the abbot of Londonderry (Cellenigre) in the diocese of Derry (Deren.), and the archdeacon and the official of Derry. Mandate to collate and assign to John Macgillabhride, clerk, of the diocese of Derry, who has been made a clerk notwithstanding his illegitimacy as the son of a priest and an unmarried woman, the rectory of the parish church of Maghbile alias Nouuport in the said diocese, value not exceeding 20 marks sterling, so long void (because Nellanus Odochartaigh, having obtained it by canonical collation, held possession for more than a year without having himself promoted to any holy order, and without dispensation), that its collation has lapsed to the apostolic see, although the said Nellanus, who is to be summoned and removed, has, without any new title, detained possession for between five and ten years after the said year. The pope hereby dispenses the said John to be promoted to all, even holy orders and receive and retain the said rectory, notwithstanding the said defect, etc. Vite etc. (At the end: N. Mandate to collate and assign to Odo Okyrnnan, clerk, of the diocese of Dublin (who alleges that after he had been made a clerk by authority of the ordinary, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, he was dispensed by papal authority to be promoted to all, even holy and priest's orders and hold a benefice even with cure), the rectory of the parish church of Inssemotolmog in the said diocese [of Dublin], value not exceeding 20 marks sterling, which is of lay patronage and has been so long void that its collation has lapsed to the apostolic see, although Edmund Okyrnnan, priest, who is to be summoned and removed, has detained possession for between thirteen and fifteen years without any title, and from fear of whose power the said Odo cannot safely meet him in the city and diocese of Dublin. To Thomas, bishop of Annaghdown (Enachdunen.). Grant, as below. The pope lately dispensed him to receive and retain in commendam for life with the said church of Annaghdown and the parish church of Charleton in the diocese of Exeter, which he was holding in commendam by papal grant and dispensation, any two secular benefices, and if he resigned the said parish church any three secular benefices, with cure or otherwise incompatible, (fn. 8) even if chantries etc., or dignities etc., or parish churches etc., and therewith one regular benefice with or without cure, even if a priory etc., and to resign them when he pleased, provided that of such three incompatible benefices not more than two were parish churches, etc. The pope now grants to him in commendam for life the priory of Down, O.S.B., a major dignity wont to be held by monks of Down, and value not exceeding 80 marks sterling, void by the death of Oliver Valsche extra R.c., and reserved to the pope under his late reservation of all major dignities in cathedral churches, to be held by the said bishop in accordance with the said dispensation, and as one of the said three benefices. To the abbot of St. Mary's, O'Dorney (de Kyrieleyson), and the prior of Ballinskelligs (sancti Michaelis de Ruffe, recte de Ruppe, i.e. de Rupe), in the diocese of Ardfert, and the official of Ardfert. Mandate, as below. The pope has been informed by William Fytzmoris, clerk, of the diocese of Ardfert, that, in contempt of the clerical order, Nicholas Fytzmoris, a canon of Ardfert, has taken part in arms in divers conflicts in which many were slain, (fn. 9) and that James Ochanagayr, perpetual vicar of the parish church of Lissmoli (?) (fn. 10) in the said diocese, in the time of an interdict laid by the archbishop of Cashel celebrated many times masses and other divine offices in contempt of the Keys. The pope, therefore, hereby orders the above three, if the said William will accuse the said Nicholas and James before them, to summon them, and if they find the foregoing to be true, to deprive and remove the said Nicholas from his canonry and prebend of Ardfert, and the said James from the said vicarage, and in that event to collate and assign the said canonry and prebend, value not exceeding 3 marks sterling, to the said William, and thereupon to unite to them the said vicarage, value not exceeding 8 marks sterling, for as long as he shall hold the said canonry and prebend.
