Reservation (he having this day resigned to the pope the parish church of Disart in the diocese of St. Andrews, and the pope having made collation and provision thereof to Thomas Kanedi [sic]), of a yearly pension for life of 55 marks of the money current in Scotland, which do not exceed 12l. sterling, on the fruits etc. of the said church, to be paid by the said Thomas, who has consented, and his successors, half at Michaelmas and half at Easter; with the usual sanctions for non-payment. Vite etc.

To the treasurer of Cloyne (Clonen.), Maurice Canto(n), a canon of the same, and the official of the same. Mandate, as below. The pope has learned that the perpetual vicarages of the parish churches of Mathethe and Eluenyryhyny (recte Cluenyryhyny), (fn. 3) in the diocese of Cloyne, have been so long void that their collation has lapsed to the apostolic see, and that there is no certain knowledge of the mode of voidance of the said vicarage of Mathethe. And the recent petition of Charles (fn. 4) alijacenfaelay otuama (? recte Macenfaelay otuama), priest, of the diocese of Ardfert, contained that the fruits etc. of the said vicarage of Mathethe are too slight for the maintenance of the vicar of the said churches, (fn. 5) and that if the said vicarage of Cluenyryhyny, value not exceeding 3 marks sterling, were united for his life to that of Mathethe, value not exceeding 5 marks sterling, he could maintain himself, that they are so near together that they can be served by one man, and that John, archbishop of Cashel, the metropolitan, lately made collation and provision to him of the said vicarage of Mathethe by his ordinary authority, and that in virtue thereof he obtained possession, but, after receiving part of its fruits for about a year in good faith, has resigned it. The pope, therefore, hereby orders the above three to collate and assign the said vicarage of Mathethe to the said Charles, and to unite thereto that of Clueny[ry]hyny for his life. To the bishops of Beirut (Biricen.) and Ross. Mandate, as below. The recent petition of Robert Ynkepenne of Longeparissh, layman, of the diocese of Winchester, contained that formerly Cristina Stargrave, mulier, of the same diocese, falsely alleging that he had contracted marriage with her, brought him before Thomas Winterbinen’ [sic], judge of the court of Thomas, cardinal priest of St. Ciriac's in Thermis, who holds by papal dispensation the church of Canterbury, and by reason thereof is legatus natus of the apostolic see in those parts; and that the said judge, wrongfully proceeding, promulgated a definitive sentence in favour of the said Cristina and against the said Robert, who appealed therefrom to the said see; and that the said judge, in contempt of the said appeal, although the said Robert was within the lawful time for its prosecution, proceeded to execution of the said sentence, and excommunicated him. The pope therefore, hereby orders the above two bishops to summon the said Cristina and others concerned, provisionally (fn. 7) absolve the said Robert from the said sentence, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To Thomas Dauet, rector of the parish church of St. Olave in Suthwerk, in the diocese of Winchester, S.T.M. Dispensation, as below. Paul II dispensed him to receive and retain for life with the parish church of Slapton in the diocese of Lincoln, which he was then holding, any other benefice, and, if he resigned the said church, any two benefices, with cure or otherwise incompatible, even if parish churches etc., or dignities etc., and to resign them, simply or for exchange, as often as he pleased. The pope now dispenses him (who is of noble birth, and is principal almoner of Edward king of England, and who, having resigned the said church, has obtained by canonical collation the parish churches of St. Olave in Suthwerk and St. Mary, Calais (in Calesio), in the diocese of Winchester and Canterbury, and holds them in virtue of the said dispensation), to receive and retain for life with the said two churches, or, without them, with any two other benefices with cure or otherwise incompatible, any third benefice with cure or otherwise incompatible, even if a parish church etc., or a dignity etc., and to resign it, simply or for exchange, as often as he pleases, provided that of such three benefices not more than two be parish churches or perpetual vicarages. To the abbot of Holy Trinity, Annaghdown (de Cellaparva), in the diocese of Annaghdown (Enachdunen.). Mandate, as below. The pope has learned that the perpetual vicarages of the parish churches of Balydiuclan and Furoanmor in the diocese of Annaghdown have been void so long that their collation has lapsed to the apostolic see, although Odo Ykallanain, priest, of the said diocese, has detained possession of them for between six and seven years without any title. And the recent petition of Maurus Okanelud, dean of Annaghdown, contained that after Martin V and Eugenius IV had renewed all sentences of excommunication etc. by former popes against simoniacs, and after Paul II had aggravated the same, the said Maurus, wishing to buy off (fn. 12) certain vexations and molestations which were being inflicted on him by Dermit Ohalluran, priest, of the said diocese, before a certain judge, about the perpetual vicarage of the parish church of Machulid in the said diocese, canonically annexed to the said deanery, gave and paid a sum of money to the said Dermit, in order that he should acquiesce in the sentence to be delivered, thereby incurring simony and the said censures etc.; and that, when under the said sentences, etc., he took part in divine offices, but not in contempt of the Keys. At the petition, therefore, of the said Maurus, who alleges that the said vicarages were united for the lifetime of their holder, the pope hereby orders the above abbot to absolve the said Maurus (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and receive and retain any compatible benefices, of any number and kind, with or without cure, and to resign them, simply or for exchange, as often as he pleased, in virtue of which he obtained and holds the said deanery, value not exceeding 3 marks sterling, collated to him by the said authority), from the guilt of simony and from the said sentences etc., enjoining a salutary penance, etc., dispense him on account of irregularity incurred, and rehabilitate him, and in the event of his so doing, to summon the said Odo and others concerned, unite the said vicarages, value not exceeding 8 marks sterling, for the lifetime of the said Maurus, and collate and assign them to him, removing the said Odo. The pope dispenses him to receive them and retain with them for life the said deanery, or without them any two other benefices with cure or otherwise incompatible, even if parish churches or perpetual vicarages, or dignities etc., and resign them, simply or for exchange, as often as he pleases. Reservation, at his recent petition (containing that for the implementing of a certain honest agreement between him and John Falconner, perpetual vicar of the parish church of Cupar (de Cupro) in the diocese of St. Andrews, about which a suit was pending before a certain papal auditor, he has desisted from the prosecution of his right in and to the said vicarage, and has left the said John in peaceable possession), of a yearly pension for life of a third part of the fruits etc. of the said vicarage, which do not exceed a yearly value of 16l. sterling, to be paid by the said John (who has consented by his proctor, Nicholas Manni de Castello, I.U.D., a consistorial advocate (fn. 14) ) and by his successors, half at Candlemas and half at St. Peter's in Chains, in the church of St. Andrews; with the usual sanctions, etc. Vite etc.

Motu proprio revocation of the grant in commendam which the pope lately made for five years, and thereafter (deinde) at the pope's pleasure, to Patrick archbishop of St. Andrews (who has not had possession or quasi-possession (fn. 15) ), of the monastery of St. Thomas the Martyr, Aberbrothoc, O.S.B., in the diocese of St. Andrews, on its becoming void by the death of abbot Alexander extra R.c., the pope's intention being to make provision thereto this day of an abbot by whom it may be circumspectly ruled and wholesomely directed.
