(fn. 2) Indult, at his recent petition (containing that on account of his age and the slenderness of the fruits of the said perpetual vicarage of Wilkesdon [sic] in the diocese of London (Lunden.) (fn. 2) he cannot reside in it in person and bear its burdens), that as long as he lives he may, whilst residing in any other benefice with or without cure, receive the fruits etc. of the said vicarage, except the daily distributions, and not be bound to reside in it; notwithstanding papal constitutions, and those of Otto and Ottobon, sometime legates in England, etc. Vite ac morum. To the archbishop of York. Mandate, as below. The recent petition of the inhabitants of the vills of Bellerby hamlet and Skeltoncota, situate within the bounds of the parish of Spennethorne in the diocese of York, contained that (fn. 3) they are about two miles distant from the said parish church, and that the river called Abidelbek, which separates the said vills of [Bellerby] hamlet and Skentelcota [sic] from the place of the said parish church, (fn. 4) is so much swollen in winter that the said inhabitants, who number more than a hundred, are often prevented from receiving the Communion from the rector of the said church, and from going to the said church to hear divine offices, wherefore in times past divers (fn. 5) persons have died without confession and the Eucharist, and without receiving other sacraments, and the like, and worse, is feared in future. (fn. 5) The said petition added that if it were granted to the said inhabitants that in a certain chapel which is situate in the said vill of Bellerby hamlet, within the said bounds, and is at all times convenient to them, and which has a dwelling-place suitable for a priest, (fn. 6) a priest should be appointed by the rector of the said church, to celebrate masses and other divine offices therein, and administer ecclesiastical sacraments to them, and that if to such priest suitable provision were made from the fruits etc. of the said chapel, the rector of the said church could nevertheless maintain himself, etc. At the petition, therefore, of the said inhabitants, who allege that the fruits etc. of the said chapel and church do not exceed in yearly value 80 and 160 gold florins of the Camera, respectively, praying the pope to order some upright men in those parts to ordain and decree that the present rector and the rector for the time being shall keep a fit priest, who shall have a suitable provision from the fruits etc. of the said chapel, and shall celebrate masses and other divine offices therein at least thrice a week, and minister in perpetuity ecclesiastical sacraments to the said inhabitants, and to order them to compel the said rector and the rector for the time being to do so, the pope hereby orders the above archbishop to summon the said rector and others concerned, and make such provision in regard to the foregoing as he shall think expedient. To Nicholas Ross', priest, of the diocese of St. Andrews. Grant, as below. The pope motu proprio made him provision, under date Kal. Jan. anno 1 [1 Jan. 1471 /2], of a canonry with reservation of a prebend and dignity etc. of Glasgow, and of a benefice wont to be assigned to secular clerks in the collation etc. of the abbot and convent of Paisley (de Pasleto), (fn. 10) O.S.B., in the diocese of Glasgow. In order that the said letters may take effect as soon as possible, the pope hereby grants to him (who was lately dispensed on account of illegitimacy, as the son of a married knight and a married noblewoman, (i) by authority of the ordinary to be made a clerk, (ii) after he had been made a clerk, by papal authority to be promoted to all, even holy orders, and hold any compatible benefices with and without cure, of any number and kind, even if canonries and prebends, etc., dignities, etc.), that in obtaining the said canonry and prebend and benefice he may enjoy the same privileges and precedence as are enjoyed by continual commensal members of the pope's household, as if he were one of them. Mandate to grant in commendam for life to Philip Thancard alias Oconchuhyr, priest, of the diocese of Waterford, the priory of St. John the Evangelist, called a wardenship or administration, O.S.B., in the said diocese, which is not conventual, nor a dignity nor a personatus, is non-elective, depends on the church of Bath, and is wont to be held by monks thereof, removeable at the will of the prior of that church, has cure, and whose value does not exceed 30 marks sterling. To John Ottirburn, clerk, of the diocese of Glasgow, licentiate in decrees. Decree, as below. Paul II dispensed him to receive and retain with the provostship of Meffen in the diocese of St. Andrews, which is a principal dignity, any other benefice, or if he resigned the said provostship any two other benefices, with cure or otherwise incompatible, even if parish churches, etc. or dignities etc., namely, for seven years only if they were parish churches or perpetual vicarages, or if not for life, and to resign them, simply or for exchange, as often as he pleased, the said letters stating that he was holding the said provostship, that it was in the diocese of Glasgow, and that it was elective. Upon its being subsequently set forth to the said pope on his behalf that at the date of the said letters he was not holding the said provostship, that it was in the diocese of St. Andrews, and not in that of Glasgow, and that it was not elective, wherefore he doubted lest they were without force and surreptitious, the said pope, under date 8 Id. June anno 5 [6 June, 1469], granted that they should hold good from the said date, as if they had not contained the said statements. The said pope having died before his letters were drawn up, the pope hereby decrees that they shall take effect from the said date, and that these presents shall suffice as proof thereof.
