To the abbot of St. Mirren's, Paisley (sancti Murini de Pasleto), in the diocese of Glasgow, the precentor of Glasgow, and William Sympil, a canon of the same. Mandate, as below. The recent petition of the prior and chapter of the church of Whiteherne (Candidecase), O. Praem., contained that although the taking of all the tithes of fruits growing in the open field (in territorio) of the place of Byscoby in the diocese of Whiteherne, which is within the bounds of the parish of the said church, belongs to the said prior and chapter, nevertheless abbot William and the convent of Dundranen, O. Cist., in the said diocese, alleging that the right of taking the said tithes belongs to them, obtained papal letters to the archdeacon of Glasgow and Thomas Penwen, a canon of the same, and caused the said prior and chapter to be cited before Gilbert de Rerick, archdeacon of Glasgow, and the said canon Thomas, who, wrongfully proceeding, promulgated an unjust sentence in favour of the said abbot and convent and against the said prior and chapter; and that the latter appealed to the apostolic see, but have been prevented by a lawful impediment from prosecuting their appeal within the lawful time. The pope, therefore, hereby orders the above three to summon the said abbot and convent, and if they find true what is alleged in regard to the said impediment, to proceed in the appeal cause, and confirm or annul the said sentence, without appeal. To Rory, abbot of St. Broganus's, Mothel (de Motalia), O.S.A., in the diocese of Lismore. Grant, as below. On the said monastery becoming void because Thady Ombrissa obtained the priory of St. Catherine, Waterford, O.S.A., collated to him by papal authority, Paul II ordered provision of it to be made to the said Rory, his letters stating that its fruits, etc., did not exceed 40 marks sterling in yearly value. His recent petition contained that the executors of the said letters made him provision, and that in virtue thereof he has obtained possession, and that the said fruits exceed, not only 40, but 60 marks. The pope, therefore, hereby grants that the said letters and their consequences shall hold good from the date of these presents, as if they had stated that the said fruits, etc., did not exceed 60 marks. To the official of Kilfenora (Fynaboren.). Mandate to cause John Ochonnabayd, a canon of Kilfenora (who was lately dispensed by papal authority on account of illegitimacy, as the son of a bishop and an unmarried woman related in the simple third degree of affinity and the simple fourth degree of kindred, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was made a clerk), to be received as a monk of the monastery of St. Mary, Corcomroe (de Petra fertili), O. Cist., in the diocese of Kilfenora, give him the regular habit, and receive his profession, and thereupon make provision to him of the said monastery, value 24 marks sterling, without an abbot, and so long void that its provision lapsed to the apostolic see; summoning and removing Laurence Otyermai [sic], a monk of the said monastery, who, under pretext of certain false letters, has without any canonical title detained possession for about ten years. The said John has hereby special dispensation to hold the monastery, notwithstanding the said defect, etc., and grant to be blessed by any catholic bishop in communion with the said see. Mandate, recapitulating the preceding, after it has been executed, to collate and assign to the above William Olonregan, who is in his twenty-fifth year, the above-named priory of St. Mary, Cathyr, conventual, dependent on no monastery, elective and with cure, value 60 marks sterling, so long void that there is no certain knowledge of the last mode of voidance, and that its collation has lapsed to the apostolic see; summoning and removing Eugenius Maceray, who, under pretext of an election only, has without any title or other right detained possession for between fourteen and sixteen years, and from fear of whose power the said William cannot safely meet him in the city or diocese of Lismore; whether it be void by the resingnation of the late William Tobyn, or in any other way. Mandate to collate and assign to Alan Hobuntar, a Friar Preacher, the perpetual vicarage of Holy Trinity by Ramsay, in the diocese of Sodor (dependent on the Premonstratensian priory of St. Ninian in the diocese of Whiteherne (Candide case), and wont to be governed by canons thereof, and value 6l. sterling), so long void that its collation has lapsed to the apostolice see; summoning and removing Michael Magbrayar, a Premonstratensian canon, who without any title, and without having obtained any dispensation on account of illegitimacy, as the son of a Cistercian monk and an unmarried woman, has detained possession for between about nine and ten years. To the treasurer of Waterford. Mandate, as below. Upon the priory of St. Catherine, O.S.A., in the diocese of Waterford, being about to become void by Paul II's promotion of Thady, [now] bishop, then elect of Down and Connor, and by the consecration which was to be conferred on him, the said pope united it to the episcopal mensa of the said churches for the life of the said bishop. The present pope has been informed by Patrick Cantwell, a canon of the monastery of St. Mary the Virgin, Cathyr, of the said order, in the diocese of Lismore, that the said bishop, being under sentence of excommunication by papal authority, has taken part in divine offices in contempt of the Keys, thereby contracting irregularity, that in the said priory, which is more than a hundred miles distant from the said churches [of Down and Connor], divine worship is diminished, hospitality not kept, and the substance of the poor dissipated, that the life of the canons is relaxed, that the priory itself suffers great hurt and the rule of St. Augustine, etc., is not observed, and that the said bishop has converted divers of its goods to evil and unlawful uses. The pope, therefore, hereby orders the above treasurer, if the said Patrick (who lately, when a secular clerk, was dispensed by papal authority on account of illegitimacy, as the son of a bishop and an unmarried woman, to be promoted to all, even holy orders, and receive and retain a benefice even with cure, has made his profession of the said order, and has without canonical title taken the fruits, etc., of the said priory, to a value of 6 marks sterling, and whom the pope hereby rehabilitates on account of the foregoing, and absolves from any sentences of excommunication, etc.), will accuse the said bishop before the above treasurer, to summon the said bishop, and if he find the said statements to be true, to dissolve and annul the said union, and remove the said bishop from the said priory, and in that event to collate and assign it, conventual, with cure and elective, and value 80 marks sterling, to the said Patrick, first receiving from him the usual oath of fealty according to the form enclosed. The pope hereby specially dispenses him to receive and retain it, or without it any other benefice with or without cure wont to be held by canons of the said order, even if a priory, etc., and to resign the said priory of St. Catherine or such benefice, simply or for exchange, when (fn. 13) he pleases. Cist., in the diocese of York (containing that the fruits, etc., of the said monastery are so much diminished by wars, floods, and other disasters, that they cannot easily maintain themselves decently and keep hospitality, etc.), to appropriate in perpetuity to the said monastery, after duly informing themselves, the parish church of Aynderby, commonly called Cuncampanille, (fn. 15) and the chapel without cure of St. Leonard, West Wytton, situate within the bounds of the parish of Wensley in the said diocese, which [church of Aynderby and chapel] are in the presentation of the said abbot and convent, the value of the said church of Aynderby and the said chapel not exceeding 54l. sterling, and that of the monastery being taken as expressed by these presents; so that the abbot and convent may cause the said church and chapel to be ruled by monks of the said monastery, appointed and removed at the pleasure of the abbot and convent.
