Confirmation, as below. The recent petition of the dean and chapter of the [collegiate] church of Holy Trinity and the Apostles Peter and Paul, Westbury by Bristol, in the diocese of Worcester, contained that John, bishop of Worcester, united in perpetuity to their mensa, for the use of the dean, without the consent of the chapter of Worcester being required, (fn. 1) the parish church of Kempsey in the said diocese, with its annexed chapels of Norton and Stulton, the licence of king Edward having been obtained, and saving the ancient portion assigned for the perpetual vicar who serves the cure of the said parish church; the said bishop reserving for himself and his successors 6s. 8d., and to the prior and chapter of Worcester 3s. 4d., payable yearly at Michaelmas, etc. At the petition of the dean and chapter, alleging that the said union etc. have not yet taken affect, the pope hereby confirms the same; with exemplification of the said bishop's letters, which (drawn up in the form of a public instrument, and subscribed, etc., by Robert Enkbarow, clerk, notary public by papal authority, and sealed with the bishop's seal, in the year 1473, indiction 6, anno 3 Sixtus IV, September 2, in a certain honest room within the said college, in the presence of Master William Vauce, canon of Salisbury, John Late(n)ner and Richard Clent, literates, of the dioceses of London, Norwich and Worcester, witnesses) (fn. 2) state that it has been set forth to him by William Canynges, dean of the collegiate church and college of Holy Trinity etc. (as above), of the bishop's foundation and patronage, and by the chapter of the same place, that their revenues are not sufficient for their burdens, that they are bound to celebrate solemnly every year the obit of Richard, duke of York, and Edmund, earl of Rutland, the said king's father and brother, to pray for the good estate of the king and Elizabeth his consort, and after their death to celebrate their obits, and that on the said occasions the dean has to distribute, in accordance with the said bishop's ordinance, 20s. amongst the fellows of the college and the priests of the new chapel, (fn. 3) the clerks, boys, poor and widows then there present; and that the dean is bound to keep hospitality and entertain the guests of the fellows and ministers of the college: wherefore, at the petition of the dean and chapter, the bishop unites etc., as above, the said church of Kempsey, which is in his gift, with its said chapels, etc. (as above). To the archpriest of Dromore, and John Osyelle and John Oberiyn [? recte Oberryn], canons of the same. Mandate to collate and assign to Patrick Mageayn, clerk, of the diocese of Down (Dunen.), the archdeaconry of Down, a major elective dignity with cure, value 5 marks sterling, which became void by the death of John Macurwart without the Roman court, and reserved under the general reservation of all major dignities by Paul II, who died without disposing thereof, and which therefore remains reserved to the present pope; the said Patrick alleging that he has held it for about a year without any canonical title, and that he was lately ordered by authority of the ordinary to be dispensed on account of illegitimacy, as the son of unmarried parents, to be promoted to all minor orders and hold a benefice without cure, and afterwards by papal authority to be promoted to all, [even] holy orders and hold another benefice, even with cure, that he was thereafter made a clerk, and obtained by collation made by the ordinary, and now holds, a perpetual benefice called the parcel of Kindchade (fn. 4) in the said diocese, value ½ mark sterling, that Henry Fox, priest, of the said diocese, has, under pretext of a collation made by the ordinary against the said reservation, detained the said archdeaconry for about seven years, and that he cannot safely meet Henry in the city or diocese of Down. To John Edwar[d]son, (fn. 5) M.A. Collation and provision of the rectory of St. Mary's, Benham, in the diocese of St. Andrews, as below. On its voidance and its consequent reservation, by the resignation to the pope, without having had possession, of John Lumysden (to whom provision had been made by papal authority on its voidance by the death of Laurence Pyot without the Roman court, and who in a cause in the apostolic palace against Gilbert Kannedi, the then possessor, and certain clerks, of the dioceses of St. Andrews and Glasgow, obtained a definitive sentence by which the said church was adjudged to him), the pope on 11 Kal. Jan. anno 2 [22 Dec. 1472] ordered provision to be made to James Lyndesay, clerk, of the diocese of St. Andrews. Seeing that without the letters thereof having been drawn up, James has this day resigned the said grant to the pope by his proctor Bryce Bobille, dean of Reims, whereby the said church is still void and reserved, the pope makes collation and provision thereof, value 35l. sterling, to the said John.
