7 Sixtus IV.
1477[–8]. 4 Id. Feb. (10 Feb.) St. Peter's, Rome. (f. 40v.) |
Decree, etc., as below. The recent petition of Master John Gerona, clerk, of Tortosa, (fn. 1) doctor of decrees, a scriptor and member of the household of the pope, contained that by privilege of Edward, king of England, granted for his long services to the king, prelates and other ecclesiastical persons, he has been declared to be like a native of the realm, (fn. 2) especially in order to enable him to hold and acquire benefices like a native, (fn. 3) but that possible collators of such benefices are afraid lest, when they become void by his resignation or death, etc., they may be held to be thereby generally reserved to the pope, especially because of his being a scriptor, etc. In order, therefore, that the said king, etc., may not be deterred from their purpose, and that he may not be deprived of the effect of the said privilege, the pope hereby decrees and declares that all such benefices as may be collated to him, whenever they become void as above, even at the apostolic see, shall be not reserved to the pope, generally or specially, but shall be entirely exempted from any such reservations, and grants indult that their collators shall be able to dispose of them as freely as before. Ad fut. rei mem. Et si cunctarum. [41/5 pp.] (fn. 4) |

1478. 5 Kal. July. (27 June.) St. peter's, Rome. (f. 133r). |
To William Hervey, priest, of the diocese of York. Absolution, etc., as below. His recent petition contained that he obtained by collation of the ordinary two perpetually united chantries in the church of London, and that he swore in a general way (fn. 5) to observe the statutes of the said church, without any statute being particularly expressed; that the present dean has required him, under pain of perjury, to observe certain statutes which were expressed to him subsequently, and which his predecessors in the said chantries were never required nor bound to observe, and were not bound under the foundation to observe, to the grave prejudice of him and his successors; and that he replied to the said dean that he would always be willing to satisfy the foundation and statutes of the said chantries and church in like manner as he and his predecessors had done. At his said petition, which added that he fears last he has therefore perhaps incurred perjury, and been excommunicated by the said dean, (fn. 6) the pope hereby absolves him from any perjury which he may have committed, and from sentences of excommunication, etc., with which he may be bound on account of the aforesaid, dispenses him on account of any irregularity contracted, and rehabilitates him; with inhibition to the said dean and any others, under pain of eo ipso excommunication, to molest him as long as he observes all that his predecessors were bound to observe. Sedes apostolica. (In the margin. Jul.) [2 pp.] |
11 Kal. May. (21 April.) St. Peter's, Rome. (f. 158r.) |
To Thomas Burton, a brother (fn. 7) of the poor hospital of St. Leonard alias St. Peter, York. Dispensation, at his recent petition (containing that although in accordance with its statutes the brethren (fn. 8) take the three vows of religion, and wear a habit like that of canons regular of St. Augustine, they do not belong to any approved order), (fn. 9) so that he (who is a priest, wears the said habit, and has taken the said three vows) may receive and retain for life with the portion which he receives in the said hospital any benefice with of without cure wont to be held by secular clerks, even if a parish church, etc., and may resign or exchange it, etc. Religionis zelus, vite etc. (In the margin: Maij.) [2 pp.] |

To John Parmenter, rector of SS. Peter and Paul the Apostles', Abindon’ by (fn. 10) Northh[a]mpton, in the diocese of Lincoln, licentiate in civil law. Dispensation, as below. Pius II dispensed him to receive and retain for life with the above church any other benefice with cure or otherwise incompatible, and to resign or exchange them [Cal. Papal Lett. XII. p. 588]. The pope now dispenses him (who in virtue of the said dispensation obtained and holds with the said church the rectory called a parsonage (fn. 11) of the parish church of Holy Innocents, Addesham, in the diocese of Canterbury), to receive and retain for life with them, or with other two incompatible benefices, any third benefice, major or principal, with cure or otherwise incompatible, even if an elective dignity, etc., and to resign or exchange it, etc. Litterarum scientia, vite etc. (In the margin: De.) Dispensation for him, who receives a yearly portion of the fruits, etc. of the said house or college (the foundation statutes of which provide that a fellow thereof or the receiver of such portion cannot hold any benefice with or without cure), to receive and retain for life with the said portion any benefice with or without cure, or, if he resign his portion, any two benefices with cure or otherwise incompatible, even if, etc., and to resign or exchange them, etc. Vite etc. (In the margin: Oct.) 1477[–8]. Prid. Non. Mar. (6 Mar.) St. Peter's, Rome. (f. 481r.) |
Decree, as below. The recent petition of the prioress and nuns of the house of [St. Mary], Clerkenwell, in the suburbs of London, O.S.A., contained that the chapel commonly called Muswell Cappell’ within the bounds of the parish church of Harnesey in the diocese of London (which depends on the said house), is renowned for the miracles which are worked by the divine grace and the merits of the Blessed Virgin, (fn. 12) wherefore there is a great resort thither of the faithful, especially on the feast of the Assumption of the same Blessed Mary [Aug. 15] until the last vespers of the octaves of her Nativity [Sept. 8], [and] on Good Friday (fn. 13); and that the prioress and nuns have begun to build a church at the said house in honour of Almighty God and His glorious Mother the Virgin Mary. The pope, therefore, hereby decrees that all the faithful who, being penitent and having confessed, visit the said church, when it is built and consecrated, on Good Friday and from the first vespers of the feast of Corpus Christi to the last vespers of the same feast, and who visit the said chapel from the first vespers of the feast of the Assumption of the Blessed Mary to the last vespers of the octaves of the Nativity of the same, and give alms for the maintenance and increase of their buildings, and for the purchase, etc. of books, chalices, lights, etc., shall gain, for each of the said feasts, twenty years of indulgences, and that the prioress and nuns may choose three or four priests, secular or regular, who may on the said days and feasts hear the confessions of the faithful, absolve them from all their sins, except in cases reserved to the apostolic see, and enjoin penance, and may also commute their vows of pilgrimage and abstinence, except only vows of pilgrimage to the Holy Land, Rome and Compostella. (fn. 14)Ad perp. rei mem. Ineffabilia meritorum insignia. (In the margin: Apri.) [22/3 pp. See Reg. Vat. DCLXVI, f. 81r., above, p. 224.] |
