To the prior of St. Mary's, Bridgetown (Ville pontis), in the diocese of Cloyne (Clonen.), and the dean and chancellor of Cloyne. Mandate, as below. The pope has been informed by James Fitz Philip (Philippi) [Fitzgerald], rector of Morachigalia (?) (fn. 1)alias Carkathkahat (?) (fn. 1) in the diocese of Limerick, that Thomas Rucel, priest, bargained with Gerald de Geraldinis, then dean of Lismore, that if he would resign the deanery in order that provision should be made to Thomas, the latter would procure for him in the Roman court provision of the then void monastery de Casbro [sic] O. Cist., in the diocese of Cloyne, and would also pay him a sum of money, thereby committing simony and incurring excommunication etc.; that in consequence of the said bargain Gerald resigned the deanery to the present pope; and that the pope, in ignorance of the said bargain, admitted the resignation, and made and ordered to be made provision of the deanery to Thomas, who under pretext thereof obtained possession, and paid Gerald the said sum. The said provision being therefore without force, and the deanery therefore still void as above, and consequently reserved, the pope hereby orders the above three, if the said James (who is of noble birth, and was lately dispensed to receive and retain for life with the said rectory, of lay patronage, the deanery of Cloyne, or in their stead any two other benefices with cure or otherwise incompatible, even if major or principal dignities etc., and who has no hope of obtaining justice against Thomas in the city and diocese of Lismore), will accuse Thomas before them, to summon the latter, and if they find the foregoing to be true, to declare the said letters and the collation and provision made to him under pretext thereof of the said deanery of Lismore null and void, and in that event to collate and assign the said deanery, a major elective dignity with cure, value 30 marks sterling, to the said James, the said Thomas being removed. To the archbishop of Cashel, the abbot of St. Mary's, Monasteranenagh (de Maio), in the diocese of Limerick, and Thomas Contolini (?), a canon of Limerick. Mandate to collate and assign to John Fyssinorum (? recte Fyssmoris), clerk, of the diocese of Ardfert, who was lately dispensed by papal authority on account of illegitimacy, as the son of a clerk and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, the perpetual vicarage of Dyssert Odrillac, by ancient custom in the patronage of the abbot and convent of SS. Peter and Paul's, Ratire, O.S.A., in the said diocese, and also the perpetual vicarage of Monam (fn. 2)alias de Kilkanan in the said diocese, the said vicarages being about two miles apart, and capable of being served by one man, value together 16 marks sterling, so long void that their collation has lapsed to the apostolic see, although Cornelius Oduluna and David Branchona, priests, (whom the said John dares not meet in the city and diocese of Ardfert, and who are to be summoned and removed), have respectively detained them for several years without any canonical title. To the dean of Cloyne (Clonen.), John Baptista de Ferrariis, a canon of Modena (Mutinen.), and the official of Cloyne. Mandate, as below. The recent petition of Walter Codth, priest, of the diocese of Cloyne, contained that (after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure, and after he had been so promoted), on the perpetual vicarage of Ninche in the said diocese becoming void in a certain way, Gerald, bishop of Cloyne, made him collation and provision thereof by his ordinary authority, in virtue of which he obtained possession, but the validity of which collation and provision he now doubts. The said vicarage being, as the pope has learned, still void as above, and the perpetual vicarage of a Kyllm[a]chkyny (fn. 3) in the said diocese having been so long void that its collation has lapsed to the apostolic see, although Donald Osyenachiy (?), priest, under pretext of a collation made by authority of the ordinary after the said lapse, has detained possession of it for between three and five years, the pope hereby orders the above three to collate and assign both vicarages, value together 18 marks sterling, to the said Walter, summoning and removing the said Donald. Walter is hereby dispensed to receive and retain them for life, or any two other incompatible benefices, and also any number of compatible benefices, etc., and to resign or exchange them, etc., notwithstanding the said defect, etc. Vite etc. [6 pp.]

To Robert Brown, clerk, of the diocese of Cashel. Motu proprio reservation to the pope's gift, for collation to him (who has been dispensed by authority of the ordinary, on account of illegitimacy as the son of unmarried parents, to be promoted to minor orders and hold a benefice without cure, in virtue of which he has been so promoted; and who has studied for many years in the university of Oxford, (fn. 4) and has come to the university of Rome to learn canon law, but is compelled by poverty to return to Oxford in order to continue the said study (fn. 5) ) of a benefice with or without cure, even if an elective dignity (not major nor principal), etc., value 25 marks sterling if with cure or a dignity etc., or 18 if not, in the gift etc. of the bishop and the dean and chapter etc. of Ossory; with dispensation hereby to be promoted to all holy and priest's orders, and hold such dignity, etc. or benefice with cure, notwithstanding the said defect, etc. The present letters are to hold good as if they had been granted under date 15 Kal. Prem., in the diocese of Elphin, in which, on account of its poverty, he does not receive a canon's portion, the perpetual vicarage of Kylsabacbron (?) in the said diocese, value 4 marks sterling, so long void that its collation has lapsed to the apostolic see; summoning and removing Rory, also Okarrid, a canon of the said monastery, who has without any title detained possession for between six and seven years, and whom the said Andrew cannot safely meet in the city and diocese of Elphin. Mandate to absolve Thady (Titius,? recte Tatius) Macgillecuasta, priest, of the diocese of Kilfenora (Fynaboren.), who, upon the late Laurence Otuyur, clerk, or layman, of the said diocese, attacking him with drawn sword, struck him in self-defence with a sword which he was carrying, as a result of which the said Laurence died) from the crime of homicide, enjoining penance, dispense him on account of irregularity contracted, so that he may minister in his orders, even in the ministry of the altar, and rehabilitate him. To the abbot of St. Mary's, Ballinskelligs (de Rupe), in the diocese of Cashel, the archdeacon of Cashel, and Edmund Mares (?), a canon of the same. Mandate, as below. The pope has learned that a canonry of Lismore and the prebend of Downachmor therein and the perpetual vicarage of Maegawr in the diocese of Cashel have been so long void that their collation has lapsed to the apostolic see, although the said canonry and prebend have been detained for several years by a certain ecclesiastical person without any title. The pope, therefore, at the recent petition of Richard Boutiller, clerk, of the diocese of Cashel, rector of Kilbere in the diocese of Meath, hereby orders the above three (inasmuch as, on account of the power of the friends of the said detainer, Richard cannot safely meet him in the city and diocese of Lismore) to summon the said detainer, and to collate and assign the said canonry and prebend, value 12 marks sterling, to the said Richard, and to unite thereto, for as long as he shall hold them, the said vicarage, value 3 marks sterling, and the said rectory (value not expressed); the pope holding the name and surname, degree and nobility of the said detainer as being expressed by these presents. Mandate to collate and assign the rectories of Clwirbryn and Chilwri (fn. 6) in the diocese of Ardfert, of lay patronage, value together 40 marks sterling, void by the deaths without the Roman court of Bernard Machonichwyr and Edmund Fissmorys, respectively, to William de Mwry, clerk, of the said diocese, who is by both parents of noble birth, and has been presented by the patron of the said churches. He is hereby dispensed to receive and retain them for life, or any two other benefices with cure or otherwise incompatible, and to resign or exchange them, etc., and not to be bound for seven years, provided that within a year he be ordained subdeacon, to be promoted to any other holy order, whilst residing in the Roman court or studying letters at an university. To the abbot of St. Mary's, Middleton (de Choro benedicti), in the diocese of Cloyne (Clonen.), and William Ohirlathi (?), a canon of Cloyne. (fn. 7) Mandate, as below. The recent petition of John Maymoris (sic) de Geraldinis, a canon of Cloyne, and Walter Cotf (?) administrator of the same, contained that the said church has in the diocese certain benefices and possessions, belonging to the fabric, which have been wont to be granted by the dean and chapter to ecclesiastical persons, to farm or yearly pension, for a certain time, under a certain yearly cess payable to the fabric or to the community of the said church; and that if the said benefices etc. were granted for life, under a yearly pension, to the said John (who with the consent of the bishop and certain of the chapter at present holds and possesses the said benefices and possessions) and to the said Walter (in such wise that in the event of the death or resignation of one of them, the survivor should succeed in the said benefices etc. under the same pension), they would restore the said benefices etc. (which have hitherto been detained by certain priests, and have not rendered the pension due to the said church) (fn. 8) to the ownership of the said church, and would give a greater pension or farm than has hitherto been received. The pope, therefore, hereby orders the above two to summon those concerned, and if they find the facts to be as stated, and if they find that it will be to the benefit of the said church or fabric, to grant and assign the fruits etc. of the said benefices etc., with an increase of the said cess, to the said John and Walter, or the survivor of them, for life. This, taken with the recital on the abovementioned f. 183v., gives the complete reference to the Register of Paul II, viz. Liber I de Curia, f. 50, a register which does not appear to have survived (see above, p. 181).
