Confirmation etc., as below. The recent petition of Robert Copping, provost of the collegiate church of Wyngham in the diocese of Canterbury, contained that John [Peckham], sometime archbishop of Canterbury, in virtue of a commission by Gregory X and a confirmation by Honorius IV, erected the said church into a collegiate church, with a provostship and six canonries and prebends, the provost to have the cure and jurisdiction over the canons and the whole parish of Wyngham and all its chapels, the visitation of the provost being reserved to the said archbishop, and other grants and ordinances being made by him, as is more fully contained in his letters of erection, exemplified in those of archbishop Thomas [Arundel], here exemplified. |
---|---|
The said letters of archbishop Thomas—Universis Christifidelibus … Noverit universitas vestra, dated in his palace at Canterbury, 1 Sept. 1411, in the 15th year of his translation, exemplify from the register of the said archbishop John the following:— (i) his ordinance concerning the division of the collegiate church of Wyngham—In dei nomine amen. Universis sancte matris ecclesie filiis … frater Johannes … ad perpetuam rei memoriam que secuntur. Agente dudum et procurante … Roberto predecessore nostro, dated at Suthmalyngg(e), 12 Kal. March (18 Feb.) 1286[–7], in the 9th year of his ordination [printed in Monasticon Anglicanum, Vol. VI, pp. 1341–3.] (fn. 1) |
|
(ii) His subsequent collation, etc. under date Suthmallyngg(e), 9 Kal. March (21 Feb.) 1286/7, to Peter de Geldeford’ of the provostship of Wyngham. (fn. 2) The archbishop, whose letters are addressed to sir (fn. 3) Peter de Geldeford', his chaplain, makes collation to him of the provostship of the prebendal church of Wyngham, as ordained by the archbishop in accordance with a grant of Gregory X and an ordinance made by Bernard, cardinal bishop of Porto, in virtue of that grant, and confirmed by Honorius IV; commits to him the jurisdiction over the said church and its chapels, canons and vicars, and all its clergy and people, invests him by the archbishop's ring with the provostship and its appurtenances, and institutes him by these presents. The provostship is to consist of the fruits etc. of the said church, with all its hamlets or villages, (fn. 4) the whole of the archiepiscopal tithe of la Berthon', the chapel and tithes of the lord (fn. 5) of Overlunde, and all his tenants in Overlunde, the whole tithe of Codlringg’ (?) and Odon', the whole tithe of the field of Crul, (fn. 6) and the archbishop grants and assigns to him for his dwelling the houses near the rectory, with the meadow below the vill (fn. 7) of Wyngham, which belongs from of old to the said church. | |
The above archbishop Thomas has also found in his register or book of the taxations of benefices in his diocese, as follows: The collegiate church of Wyngham, for the portion of its provost and vicar, 60 marks, the tenth (fn. 8) 6 marks; a portion of the chapel of Esche, with other chapels and vicarages annexed thereto, 60l. the tenth (fn. 9) 6l.; a portion of the chapel of Godwyneston’ 70 marks, the tenth (fn. 10) 7 marks; a portion of the chapel of Nonyngton', with the chapel of Wymelingewelde annexed thereto, 80 marks, the tenth cvjs. viijd. (fn. 11) |
|
At the said petition [of the above Robert Copping], which added that each canon appoints in his stead (fn. 12) a vicar, whom he presents to the provost, and whom the provost receives and admits, but that the canons are sometimes negligent in presenting him [the vicar], and the [vicars] presented utterly unfit, (fn. 13) and that when divine offices are being celebrated some of the canons and vicars wander about the church and are not present with the others at divine offices in choir, and nevertheless claim to be held as being present at the said offices as regards their daily distributions and portions, the pope hereby confirms the aforesaid erection, division of the provostship and prebends, assignment of fruits to the provostship, and the other contents of the said letters, and also the statutes of the said church, in which it is provided that the sacrist must be a priest and have a stall in the choir, etc., decrees that the above-mentioned jurisdiction belongs to the said Robert and the provost for the time being, and wills that the exemption of the said jurisdiction from any superiority whatsoever, and that a certain annual procuration which the said Robert has paid to the collector of the papal Camera, as all his predecessors have also done, shall be inviolably observed. Moreover, whenever a vicar's stall becomes void, if the canon wittingly does not present within three months, the power of making provision shall for that turn lapse to the provost, and no one shall be received as a vicar unless he is qualified under the said foundation. The vicars shall always be priests, deacons or subdeacons, and in no wise laymen, and if otherwise be done, alike the canon who appoints such vicar, (fn. 14) as also the provost and other canons who wittingly receive and admit him, and he who allows himself to be so received and admitted, and behaves as a vicar in the said church, shall ipso facto incur sentence of excommunication, and if he obstinately remain thereunder for six months, they shall be eo ipso deprived of the provostship, canonries and prebends of the said church, and any other benefices held by them therein. As regards the daily distributions and the portions due to those resident in the said church, those shall be deemed to be resident and entitled to receive such distributions and portions who are present in choir in a becoming habit at the canonical hours, especially at High Mass, vespers or matins, abstaining from gossiping and conversation and the like, (fn. 15) and not those who wander about the church outside the choir, etc. The provost shall publicly denounce as excommunicate all who incur the founder's sentence of excommunication in virtue of the said foundation, shall aggravate it, and shall proceed, even to the invocation of the secular arm. In order to prevent any contention arising in regard to expenses in the said church, for the repair of books [and] vestments, the payment of tenths, and all other common burdens, the pope decrees that the provost, to whom a third of the profits of the church has been assigned in the foundation, shall pay a third of such expenses and burdens, and that the canons, to whom two thirds of the said profits have been assigned, shall bear the other two thirds, except in the case of the repair of the chancel or chancels, to the payment of which the provost shall be bound, as the rector was bound before the said erection: the repairs of all things in other chapels to pertain to the canons only. The canons shall keep personal residence at the said church in the canons’ houses etc.; oblations made since the said erection, and future oblations, and the fruits etc. of possessions and tenements shall be employed solely for the increase of divine worship in choir; none shall in future be received as provost or canons unless they be present in their own persons, and not by proxy, and unless they first of all take their corporal oath to observe all the foregoing, etc. Ad perp. rei mem. Cathedram preeminentie pastoralis. (In the margin: Aug.) [16 pp.] | |
