To the abbot of Holyrood near Edinburgh, in the diocese of St. Andrews. Mandate, as below. The recent petition of Robert Ker, a monk of the monastery of St. Mary's, Kelsow, O.S.B., in the diocese of St. Andrews, contained that Richard Roberti, [now] abbot, then a monk of the said monastery, was, on its voidance by the death of Alan, unanimously elected abbot by the convent, which election is, in virtue of immemorially observed privileges of the apostolic see, held to be ipso facto confirmed; that in virtue of the said election and privileges the said Richard obtained possession of the rule and administration; that, upon his doubting whether the said election held good, the present pope granted him provision; and that, inasmuch as he has resigned to the said convent the rule and administration and the said grant, and inasmuch as the convent has, in accordance with ancient custom, admitted the said resignation, the convent has unanimously elected the said Robert, who has consented thereto, and has, in virtue of the said election and of the said privileges, obtained possession of the rule and administration. The said petition adding that the said Robert doubts whether the said election holds good, and the said monastery being, as the pope has learned, still void as above, he hereby orders the above abbot of Holyrood, if he find fit the said Robert, who alleges that he is by both parents of noble and baronial birth, to make provision to him of the said monastery, value not exceeding 80l. sterling. The pope hereby grants that he may be blessed by any catholic bishop in communion with the apostolic see, who shall thereafter receive from him the usual oath of fealty according to the form enclosed, and send it to the pope by his own envoy without delay, by his letters patent sealed with his seal, etc. Suscepti cura regiminis. Footnotes

  • 1. On the back of the volume is the usual modern description in Italian:Paolo ii. 1466–69. Anno 2. 5. Lib. 1., and on a modern end-paper is Mgr. Wenzel's ‘An. 6. to. 4.’ A contemporary end-paper, which is also folio i. has, besides one or two contemporary scribbles, the contemporary description: Primus de provisionibus prelatorum, [de] tabellionatus [officio], et de plenaria remissione anno vto domini nostri domini Pauli pape ii, and the order ‘R(ecipe) Le, P.’ The answer of the rubricator is found, not here, where it usually occurs, but on the back of the last contemporary leaf in the volume, viz. ‘Rubricatus [est] per me Lelium de Subattariis Romanum.' The usual contemporary description, similar to the above, occurs on the bottom edge of the volume. There are ff. ii.—cccxx. of text, some of them blank, with some more blank leaves at the end of the volume.
  • 2. litterarum scientia preditum.
  • 3. Here with the spelling ‘Wastor.’
  • 4. A specimen oath in full occurs on ff. 203d–204r.
  • 5. 'smet’ in the oath.
  • 6. qui ut asserit litterarum peritiam habet.
  • 7. Cantuarien. In the oath it is ‘Cameracen.,’ an evident slip of the scribe.
  • 8. This is the longest form of the incipit which has hitherto occurred in the present series of these indults.
  • 9. On f. 239d under date 1469, 13 Kal. June (20 May) anno 5, is an indult of plenary remission addressed ‘Magistro Hugolino Folani, decano ecclesie Bisuntine, notario nostro,’ i.e. the Registrator whose name so often appears. On f. 270d, under date 1468–9, 15 Kal. April (18 March) anno 5, is an indult to the same Hugolinus, similarly addressed, to have a portable altar, but here he is further described in the body of the indult as ‘qui etiam litterarum apostolicarum scriptor existis.’
  • 10. On f. 241 is an indult of plenary indulgence, with the ‘De credito nostre solicitudiniincipit written out in full, followed by the usual brief ‘Hinc est etc. Et ne quod absit etc. Porro etc. Datum. …’
  • 11. ’Condomen.,’ cancelled and over-written ‘F(ranciscu)s’; and ‘London.' substituted in the margin by ‘F.’
  • 12. ’Aprilis’ cancelled by ‘F(ranciscu)s,’ and ‘Maii’ substituted in the margin by ‘F.’
  • 13. With f. cclxxxi. the original foliation in Roman numerals comes to an end, and the remaining leaves of the volume are foliated in pencil.
  • 14. The indult being presumably gratis.
  • 15. Rather than Silina, which can also be read, the second letter having been corrected and being dashed, and the ‘b’ having an open loop, and therefore looking like an ‘l’.
  • 16. The date has ‘anno primo,’ evidently a slip (which has escaped the ‘corrector’) for ‘anno quinto.’
