Mandate to collate and assign to David Oharcur, priest, of the diocese of Lismore, the perpetual vicarage of the parish church of Ballyspelayn in the diocese of Cloyne, value not exceeding 2 marks sterling, void by the death without the Roman court of John Gillanard, although Thomas Ochonaiyr, priest, of the same diocese of Cloyne, who is to be summoned and removed, has without any canonical title or any tittle of right detained possession for between two and three years. To the abbot of St. Mary's, Kylsenay, in the diocese of Kilfenora (Fynnaboren.). Mandate, as below. The pope has been informed by Donatus Obreyn, a canon of Killaloe (Laon[i]en.), that John Oflanagrayn [sic], rector of the parish church of Kylnafearby and Collebouum in the diocese of Killaloe, has dilapidated and alienated and converted to his own unlawful uses divers immoveable goods of the said rectory, has committed simony and perjury, and has committed fornication notoriously and in public places, and perpetrated many other excesses and delicts, to the shame of the clerical order; and the petition of the said Donatus contained that the fruits etc. of his canonry of Killaloe and prebend of Ynisskacha therein (fn. 3) are so slight that, not exceeding 20 marks sterling in yearly value, neither he nor the holder for the time being can be maintained therewith, etc., and that if the said rectory were united to the said canonry and prebend in perpetuity he and their holder for the time being could maintain themselves, etc. At the petition, therefore, of the said Donatus (who alleges that the fruits etc. of the said rectory do not exceed 16 marks sterling, that it is without cure, the cure of souls being exercised by a perpetual vicar, and that he was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents related in the simple fourth degree of kindred, to be promoted to all, even holy orders and hold a benefice with or without cure, even if it were a canonry and prebend, and that he holds the rectory of the [parish] church of Ogunachc in the diocese of Kilfenora, without cure and value not exceeding 5 marks sterling), the pope hereby orders the above abbot, if Donatus, who from fear of the said John's power cannot safely meet him in the city and diocese of Killaloe, will accuse him before the said abbot, to summon John and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event, and after summoning those interested, to unite the said rectory of Kylforaby [sic] and Collebouum to the said canonry and prebend in perpetuity, etc. Pastoralis offitii debitum. To the provost of the church of Corstorphyn in the diocese of St. Andrews. Mandate, as below. The recent petition of Andrew Hay, clerk, of the diocese of Glasgow, contained that on the voidance of the rectory of the parish church of Bigar in the said diocese, of lay patronage, by the death of John Aroys, David Haye, layman, lord of the place of Lochquhorwart in the diocese of St. Andrews, the patron, presented the said Andrew Hay to Andrew, bishop of Glasgow, who without reasonable cause has refused to institute him. The pope, therefore, having learned that the said rectory is still void as above, hereby orders the above provost, if he find the said Andrew, who is by both parents of noble birth, to be fit, to collate and assign to him the said rectory, which has cure of souls, and the value of which does not exceed 16l. sterling. To the prior of St. Thomas the Martyr's by Buttevant (iuxta Botoniam) in the diocese of Cloyne (Colonen., recte Clonen.), (fn. 5) and Dermit (Demetrio, recte Dermitio) Okeywc (recte Okeywe) and Gerald Macwyht, canons of Cloyne. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Kyllmoybo in the diocese of Cloyne is void because Cornelius Oscollor, priest, obtained it, collated to him by authority of the ordinary when holding the perpetual vicarage of the parish church of Kylbrum in the same diocese, and that he has held both for more than a month, against ‘Execrabilis,’ so that it is ipso facto reserved to the pope by the said constitution. He therefore orders the above three to collate and assign to Donatus Oscyn, priest, of the said diocese (to whom the pope has recently made provision of the perpetual vicarage of the parish church of Anachorochan alias Clonfratan in the said diocese, value not exceeding 8 marks sterling; and who alleges that the said Cornelius has detained possession of the said vicarage of Kyllmoybo for two years since the said lapse, without papal dispensation or any canonical title), the said vicarage of Kyllmoybo, value not exceeding 3 marks sterling, summoning and removing the said Cornelius and any other unlawful detainer. Mandate (the pope having been informed by Donatus [son] of Thady (fn. 6) Ysegda, priest, of the diocese of Ardfert, that Donatus [son] of Donald (fn. 7) Ysegda, perpetual vicar of the parish church of St. Mary, Glominncci, (fn. 8) in the said diocese, neglects saying the canonical hours, has dilapidated and alienated divers immoveable goods of the said vicarage, and has converted the price thereof to his own evil uses, and that on account of his negligence divers of the parishioners of the said church have died without baptism and confession), if the said Donatus Tadei will accuse the said Donatus Donaldi before the above prior, to summon the latter and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign to the said Donatus Tadei, if found fit, the said vicarage, value not exceeding 8 marks sterling.
