To the bishop of Orvieto, the archdeacon of Glasgow and the provost of Lincluden in the diocese of Glasgow. Mandate as below. The recent petition of Quintin Weir, priest, of the diocese of Glasgow, bachelor in decrees, contained that formerly, on the voidance of the rectory of the parish church of Zethem in the said diocese by the death without the Roman court of Malcolm de Haluik (recte Hawik) he (in virtue of letters of Calixtus III ordering provision to be made to him of one or two benefices wont to be assigned to secular clerks, even if one had cure etc., in the gift of the bishop and the dean and chapter etc. of Glasgow and the abbot and convent of the Benedictine monastery of Kauco (fn. 2) in the said diocese) accepted and got provision made to him of the said rectory, in the gift of the said abbot and convent, and is still in possession. The said petition adding that Quintin doubts whether for certain reasons the said acceptance and provision and their consequences hold good, the pope orders the above three to collate and assign to him, who is by both parents of noble birth, the said rectory, with cure and value not exceeding 9l. sterling. To Thomas Wollore, a monk of the Cluniac monastery of Holy Trinity, Lenton, in the diocese of York. Dispensation, on account of illegitimacy as the son of unmarried parents, to receive and retain any benefices of the said order, of any number and kind, even if provostships, priorships or dignities, but not abbatial dignities, and to resign them, simply or for exchange, as often as he pleases. To the archbishop of Cashel. Mandate as below. The recent petition of Thomas Wallse, provincial of the province of Ireland, and Donald Ygormellay and William de Burgo, of the order of Carmelites, contained that recently Kennedy Macbriayn and Torieleus (? recte Torletus), brothers, and James Deles, [all] donsels, of the dioceses of Emly and Limerick, for themselves and for the welfare of the souls of their progenitors, to the praise of the divine name and from reverence for St. Mary the Virgin, granted in perpetual frankalmoin to the said Donald and William a certain place called Milltown (fn. 3) in the said diocese of Emly, to the effect that on some part of the said place a convent of St. Mary, of the said order, should be built; and added that Donald and William accepted the said place in good faith, without having obtained any licence from the apostolic see, that they have remained in it for some time and celebrated masses and other divine offices there, not in contempt of the Keys, but that, having been excommunicated by the ordinary and proclaimed excommunicate they have given up the said place and had recourse to the apostolic see. The pope therefore orders the above archbishop, if the facts be as stated, to absolve Donald and William from any sentences etc. incurred by reason of the foregoing, enjoining penance etc., dispense them on account of any irregularity contracted, and rehabilitate them; and moreover, if he find the said grant lawful, to confirm and approve it and its consequences, and to grant licence to Donald and William and other friars of the order to build in the said place a house of the said order with church, bell-tower, bell, cemetery, dormitory, refectory, gardens (fn. 4) and other necessary offices, and to transfer themselves thither etc., saving the right of the parish church etc., without requiring licence of the diocesan and any other. Lib. 1.’ A flyleaf has, in contemporary hands, the description: ‘Primus de Exhibitis et de Regularibus anno sccundo domini nostri domini Pii pape ii,’ the order: ‘R(ecipe) Jo., P. (i.e. P. de Varris)’ and the note: ‘Quesitus per Ray(mundum) Grass(i).’ A like contemporary description: ‘Primus …’ occurs also as usual on the bottom edge of the volume.
