To the official of Ossory. Mandate to collate and assign to Maurice Chysfrenavn, (fn. 2) clerk, of the diocese of Cashel (who was lately dispensed by papal authority on account of illegitimacy, as the son of an abbot and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who in virtue thereof had himself made a clerk) the rectory of the [parish] church of Wottirrathry, called the canonry or prebend of Wottirat, in the diocese of Lismore, of lay patronage, without cure, and value not exceeding 5 marks sterling, so long void by the death of Donatus Ockammayn that by the Lateran statutes its collation has lapsed to the apostolic see. To the dean, the precentor and the treasurer of Cloyne (Clonen.). Mandate, as below. The pope has been informed by William Scysg, priest, of the diocese of Cloyne, that Thomas Sawaych, perpetual vicar of the parish churches of St. Mary, Clonmel, and St. Mary, Great Island (de Insula Magna), called Robert's chapel, (fn. 3) in the said diocese, has dilapidated very many goods of the said vicarages, has committed perjury, and has by his negligence allowed a number of his parishioners to die without the sacraments. The pope therefore hereby orders the above three, if the said William will accuse the said Thomas before them, to summon Thomas and others concerned, and, if they find the foregoing to be true, to deprive and remove Thomas, and in that event to collate and assign the said vicarages, value not exceeding 9 marks sterling, to William. The pope hereby specially dispenses him, who alleges that the said churches are so near that they can be served by one man, to receive the said vicarages, and retain them together for three years. To Nicholas, bishop of Orte, residing in the Roman court. Mandate, as below. The recent petition of Donatus, bishop of Killala (Aladen.), contained that he betook himself in person to the Roman court in the time of Eugenius IV, when he was already a Friar Preacher, for the purpose of obtaining a certain perpetual vicarage, and there, being inexperienced, (fn. 4) found a solicitor for the making of his impetration and drawing up the letters; that in a month's time the said solicitor forged and gave him certain letters sealed with a leaden seal, (fn. 5) which letters seemed to be papal, and by which provision was made or ordered to be made to him of the said vicarage, together with the appropriate dispensation, under pretext of which he obtained possession. Subsequently, after he had held possession for some time, Thomas Lauyls, (fn. 6) clerk, brought back certain other letters from the Roman court by which it was declared that the said earlier letters were false and obtained by fraud, (fn. 7) wherefore the said bishop, who had been in ignorance of such forgery, as soon as he learned it, resigned the said vicarage, and, for the easing of his conscience, although he was not guilty in the foregoing, came to the said court, and got absolution from certain collectors or nuncios of the said pope Eugenius, appointed to exact money for the expedition which he had prepared against the Turks, they alleging that they had special faculty for the purpose. (fn. 8) Afterwards, on the voidance of the church of Killala by the death of Bernard, Pius II made provision thereof to the said Donatus, who, fearing lest the time for the consecration of bishops should lapse before he had expedited the letters of his provision, got himself consecrated and obtained possession of the rule and administration of the goods of the said church, etc., and has been bishop of the said church for about six years, ordaining clerks and priests, consecrating crosses and churches, and reconciling, etc. The pope therefore orders the above bishop to absolve bishop Donatus from the said excesses, enjoining a salutary penance, and to approve and confirm all his lawful acts as bishop, and grant that he may rule and govern the said church in spirituals and temporals.   • 1. On the back of the volume is the usual modern description in Latin: 1467 (corrected from ‘1558’). An. iv. Pauli ii. (corrected from ‘iv.’), and a modern end-paper has the description in pencil ‘Paolo iio . pontificato anno ivo . to which Mgr. Wenzel has added in ink ‘to. xi.’ A contemporary end-paper has the contemporary description: Primus de benefitiis vacantibus et de exhibitis anno iiiio . domini nostri domini Pauli pape ii., the order ‘R(ecipe) B., P.’ and the answering ‘Rubricatus[est] per me Johannem Beier,’ as well as the contemporary note ‘Quesitus Jo. Bilock, et non est.' A contemporary description similar to the above, viz. ‘Primus de beneficiis …,’ occurs also, although hardly legible, on the bottom edge of the volume, as usual. There are ff. i.—cccxxxvii. of text, + ff. cccxxxviii.— cccxl. blank.
  • 2. Ill written. The ‘C’ may be intended for ‘O,’ and the ‘v’ may be ‘y,' making ‘Ohysfrenayn,’ recte Ohyffrenayn (O'Heffernan).
