To Henry Abretrome (recte Abercrome), priest, of the diocese of St. Andrews. Grant in commendam (the pope having this day ordered him to be received as a canon of the monastery of St. Mary, Composchenech, O.S.A., in the diocese of St. Andrews, the regular habit to be given to him, and his profession to be received [below, f. 12d]), of the said monastery, void by the death of David, during whose lifetime it was specially reserved to the pope's gift, the said monastery to be held and ruled by him until he shall by virtue of these presents have obtained possession of the rule and administration; with provision, moreover, of the said monastery from the time of his obtaining such possession, and his having been received as a canon, been given the habit, and made his profession, (fn. 2) as above. To Thomas Ohanyn, canon of Clonfert. Mandate (the pope having learned that Donatus Ohanynd, late abbot of the monastery of St. Mary, Abbeygormacan (Via nova), O.S.A., in the diocese of Clonfert, has resigned the said monastery on account of old age, bodily weakness, and loss of sight, in presence of several persons and witnesses, without the Roman court and in those parts, in which there are said to be no notaries (fn. 6) ), to summon the said Donatus and others concerned, and if he find the said resignation lawful, to receive and admit it by papal authority, and thereupon to make provision of the said monastery to David Condun, a canon thereof, who has made his profession, the value of the said monastery and of the parish church of Killrikill in the said diocese, which is annexed thereto, not exceeding 20 marks sterling. The pope hereby grants that he may be blessed by any catholic bishop [of his choice] in communion with the apostolic see, without prejudice to the ordinary. Solicite consideracionis. To James Guthery, abbot of the monastery of Kynlos, O. Cist., in the diocese of Moray. Provision to him, a professed monk of the monastery of Coupar-Angus (de Cupro), O. Cist., in the diocese of St. Andrew's, S.T.B., of lawful age and in priest's orders, of the above monastery of Kynlos, void by the death of John, during whose lifetime it was specially reserved to the pope's gift. Before receiving the administration, he is to take to the bishops of St. Andrews and Brechin, or one of them (whom the pope has by other letters ordered to receive it from him in the pope's name) the usual oath of fealty, according to the form enclosed (cf. the next following faculty). To George Micreff (cf. above, p. 558), abbot of the monastery of Inchaffray (Insule missarum), O.S.A., in the diocese of Dunblane. Provision, as below. Pius II, on its voidance by the death of abbot Nicholas, during whose lifetime its provision had been specially reserved by that pope, made provision of it to William Hadinchton, a canon of the same. Subsequently a dispute arose between the above George and the said William about the rule and administration, the former alleging that he had been elected by the convent, and that the election had been confirmed by authority of the ordinary, that provision had thereafter been ordered to be made to him by papal authority, and that the said William unlawfully opposed the said election, confirmation and provision, and prevented them from taking effect, the said William alleging on the other hand that the monastery lawfully belonged to him. The cause having lawfully devolved to the Roman court by the said George's appeal, the said pope committed it, at George's instance, to Master Anthony de Grassis, then, as now, a papal chaplain and auditor, and, after he had proceeded short of a conclusion, the present pope (upon being informed by the said George that the said William, before his said provision, had taken possession of the rule and administration without any title or other tittle of right, de facto and by secular power, had intruded himself, and had, by simoniacal and illicit means and also by violently constraining certain of the canons, got himself elected abbot), called up the said cause to himself, and gave viva voce commission to Berardus, cardinal priest of St. Sabina's, to make inquiry and report. Having learned from the said cardinal's report that many of the foregoing statements are true, and that even George himself has not a full right in or to the said rule and administration, and having this day declared by other letters the provision of William and the letters thereof null and void, and, having removed him from the rule and administration (see ibid.), and the monastery being therefore still void, as above, and consequently still reserved, the pope hereby makes provision of it to the said George, a canon professed thereof, a completed bachelor of theology, (fn. 8) a papal chaplain, in priest's orders, and of a race of barons. To Donatus Offerallyl and Eugenius Oradachan, canons of Ardagh, and the official of the same. Mandate (the pope having been informed by Cormac Magabr[e]nan, perpetual vicar of the parish church of Tempuillpuit (recte Tempuillpurt) in the diocese of Kilmore, that John Magbrian, who behaves as prior of St. Mary's, Drumlean, in the said diocese, O.S.A., in order to obtain that priory made with John, abbot of Kells (de Kenlys), O.S.A., in the diocese of Meath, on which monastery the said priory depends, a simoniacal agreement that if the said abbot collated and made provision to him of the said priory, and if he got possession by the abbot's help, he would pay him a large sum of money, as he subsequently did, whereupon the said abbot made him de facto collation and provision, under pretext of which he obtained possession, and still detains it, thereby incurring the sentences etc. promulgated against simoniacs), if the said Cormac (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest, professed as a canon of the said order, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who for fear of John's power cannot safely meet him in the city and diocese of Kilmore) will accuse John before them, to summon John and others concerned, and if they find the foregoing to be true, to decree and declare the said collation and provision null and void, and remove John from his said detention, and in that event to collate and assign the said priory, conventual and with cure, and value not exceeding 20 marks sterling, to Cormac, even before he receives the habit of the said order and makes his regular profession as a canon; causing him to be given the said habit, and to be received as a canon of the said monastery, and receiving his profession. The pope hereby grants him indult, that he shall be bound to receive the habit and make his profession after, and not before, he has obtained possession of the said priory, and that nevertheless the said collation and provision etc. shall hold good, as if the had received the habit and had made his profession, and also dispenses him to receive and retain the priory, and rule it in spirituals and temporals, notwithstanding the said defect, etc. As soon as he has received the habit and made his profession, etc., he shall resign the said vicarage. Dispensation to receive and retain for life any benefice with cure wont to be governed by secular clerks, even if it be a parish church or its perpetual vicarage, or a chantry, free chapel or hospital, or an annual service, (fn. 10) or be of lay patronage, and to resign it, simply or for exchange, as often as he pleases. To Donatus Offerralid, (fn. 11) Eugenius Orodacean and Cormac Magaurigan, canons of Ardagh. Mandate, at the recent petition of John Omurcha, priest, of the diocese of Kilmore (containing that although, in virtue of papal letters he accepted within the lawful time and got provision made to him of the perpetual vicarage of the parish church of Killnascendrach in the said diocese, and although by force of the said acceptance and provision the vicarage was lawfully due to him, nevertheless John Ogobund, clerk, [of the said diocese], falsely alleging that it was void by the death of Magonius Maguynd, who had no right in or to it, intruded himself, and has since unduly detained possession), to summon the said John Ogobund and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure.
