1 Pius II.
De Diversis Formis.
1458. 17 Kal. Dec. (15 Nov.) St. Peter's, Rome. (f. 8.) |
To David de Cadyhow, a canon of Glasgow. Reservation etc. as below. His recent petition contained that lately, by reason of age and bodily weakness, he resigned the precentorship (cantoriam) of Glasgow, a non-major dignity with cure, to Andrew bishop of Glasgow, who by his ordinary authority admitted the resignation and made collation and provision of it, as thus void, to Simon de Dalgles', and reserved and assigned to David a yearly life pension of 80l. of the money of the realm of Scotland on the fruits etc. of the precentorship, the yearly value of which does not exceed 150l. of the said money, the pension to be paid at Glasgow, half at Whitsuntide, half at Martinmas in winter by Simon and his successors, under pretext of which reservation and assignment he has received the pension for some time. The said reservation and assignment being without force, the pope hereby reserves and assigns to him for life the said pension, to be paid as above, Simon having consented through his proctor, Thomas de Forsich (recte Forsith), priest, of the diocese of Glasgow; with the usual penalties for delay in payment etc.; notwithstanding that David holds a canonry of the said church and the prebend of Durisdet (recte Durisder) therein, value not exceeding 18l. of the same money. Vite etc. |

Concurrent mandate to the bishop of Argyll, the abbot of Kilueny[n]g in the diocese of Glasgow, and the chancellor of Chartres. Hodie dilecto filio David. (P. and Ja. Bigneti.Ernestus. | P. xiii. xi. de Varris.) [3⅓ pp.]
1459. 7 Id. July. (9 July.) Mantua. (f. 46d.) |
To John Valente (Johanni Valen[t]e), elect of Tenos (Tinen). Grant etc. as below. The pope has learned that he (to whom, at the petition of Thomas bishop of Bath and Wells, who has alleged that he wishes to have him in his city and diocese as a suffragan, the pope has this day made provision of the said church) can receive nothing from the fruits of the episcopal mensa of that church, which is in partibus infidelium. The pope therefore (who has also this day granted by other letters an indult to him to retain in commendam for life with the said church the parish church of St. Laurence, Lydiard, in the said diocese, which he, being a canon of the Augustinian monastery of Blichburgh in the diocese of Norwich, was holding, as he still does, by papal grant and dispensation) hereby grants and assigns to him a yearly pension of 100 gold florins of the Camera on the fruits etc. of the episcopal mensa of Bath and Wells, until provision be made to him of a benefice of like yearly value, the pension to be paid by bishop Thomas and his successors at Bath on the Nativity of St. John Baptist. Personam tuam. |
Concurrent mandate to the abbot of St. Mary's, Glastonbury (Glastonie) in the diocese of Bath and Wells, and the deans of Salisbury and Exeter. Hodie dilecto filio Johanni (here Johanni Vallence). (O. and Alanus. Ernestus. | O.xvi. xiiii. Pontanus.) [32/3 pp. See below, ff. 68d. and 69, and above, Reg. Lat. DXXXIX, f. 47d.]
7 Kal. Aug. (26 July.) Mantua. (f. 50.) |
To the archbishop of Canterbury. Mandate to dispense James Borne of Dadyngton and Joan [daughter] of John Chyrche of Elyng, of his diocese, who have long been in love with one another, (fn. 2) to marry, notwithstanding the impediment of double spiritual relationship arising from the fact that James's father Bartholomew was godfather to Joan, and that Joan's father John was godfather to James at their baptism. (fn. 3) Oblate nobis. (P. and Ja. de Rizonibus. | P.xvi. de Varris.) [1 p.] |
7 Id. July. (9 July.) Mantua. (f. 68d.) |
To John Valente (Valente), elect of Tenos (Tinen). Licence to him (to whom the pope has recently [sic] made provision of the said church, requiring him, as soon as he has had the letters expedited, to betake himself to the said church and reside there in person, and forbidding him to exercise pontifical offices without his said city and diocese) seeing that he cannot conveniently go to the said church, which is in partibus infidelium, and reside thereat, that he shall not be bound to do so, and that after his consecration he may exercise pontifical offices in other cities and dioceses, at the request of their diocesans and by their special licence.Sincere devocionis affectus. (P. and A. de Cortesiis. | P.l. de Varris.) [¾ p. See above, f. 46d. and below, f. 69.] |
Ibid. (f. 69.) |
To the same (here ‘Valence’). Grant to him, to whom the pope has this day made provision of the said church, seeing that it is situate in partibus infidelium, and that he can receive from the fruits of the episcopal mensa no fruits or very few, that, even after he has been consecrated, and after he has in virtue of the said provision obtained peaceable possession of the rule and administration, he may retain in commendam with the said church the parish church of St. Laurence, Lidiard, in the diocese of Bath and Wells, which he; a canon of the order of St. Augustine, was by papal grant and dispensation holding at the time of the said provision, and still holds, and which the pope decrees not to be void by the said provision and consecration etc. Personam tuam. (P. and Alanus. | P. xxx. de Varris.) [1 p. +.See above, ff. 46d. and 68d.] |
Prid. Id. April. (12 April.) Siena. (f. 179d.) |
To the prior of Galynd in the diocese of Clonmacnoise (Cluanen.). Mandate as below. The [recent] petition of John bishop of Clonmacnoise and the dean and four priest canons who form the college instituted in that church contained that (fn. 4) formerly the said bishop and dean and the archdeacon, sacrist and chapter (considering that the canons of the said church, on account of the slenderness of the fruits of the prebends, had not proper incomes in respect of food and clothing and could not maintain themselves therewith, and therefore wandered about hither and thither, and did not reside in person, wherefore the said church suffered great detriment in regard to divine offices) instituted a college of four priest canons over and above the other scattered and non–resident canons, (fn. 5) which four should reside continually and in person serve at daily and nightly hours and say (decantarent) masses, collects and other prayers and perform divine worship; and, moreover, by their ordinary authority united and appropriated to the college, for the maintenance of the said four priests, the rectory of the parish church of Lochluacha alias de Dedealnearach (sic) in the diocese of Clonmacnoise, of the patronage of laymen, with [the consent] of the said laymen, who gave the patronage to the said dean and college for the purpose of such union and appropriation in perpetuity; in virtue of which union etc. the said dean and college, after previous institution by the archdeacon, obtained possession of the rectory and have held it thenceforward, as they still do. The said petition added that there is a doubt as to whether the erection of the college and union etc. hold good, especially because the rectory or parish church was ruled and governed for several years by monks of the Cistercian monastery of Granard (de Granardo) in the diocese of Ardagh, but not for so many years that a canonical prescription could be alleged, and because the abbot and convent have received a certain yearly pension on its fruits. At the petition of the said bishop, dean and priests of the college, alleging that its fruits are null, and that those of the rectory do not exceed a yearly value of 60 marks sterling, the pope hereby orders the above prior, if he find the facts to be as stated, to approve and confirm by papal authority the said erection and union etc. and the consequences thereof. Pastoralis officii. (P. and G. Gonne. | P. l. de Varris.) [2½ pp.] |
