Dispensation to him, who holds the said church, the value of which and of his other benefices the pope holds to be expressed by these presents, to receive and retain for life therewith any one other benefice, or without it, and if he resign it, any two benefices, with cure or otherwise incompatible, even if parish churches or their perpetual vicarages, or dignities etc., and to resign them, simply or for exchange, as often as he pleases. Mandate to absolve James Douglas, lord of Dalketh and Morton, and Janet (Joneta) Stewart, of his diocese, from sentence of excommunication incurred by contracting marriage per verba legitime de presenti, by the persuasion of the late James king of Scots, they not being ignorant that they were related in the second and third degrees of kindred, and by having offspring, enjoining penance, and thereafter, and after temporary separation, to dispense them to contract marriage anew (fn. 3) and remain therein, decreeing legitimate the offspring already born, and that to be born of the said marriage.Oblate nobis. To the abbot of Carrigillihy (de Fonte vivo) in the diocese of Ross, and Odo Ohedersceoyl and William Ogillagymayn, canons of Ross. Mandate, as below. The recent petition of John Ythuathing, clerk, of the diocese of Ross, contained that the present prior and convent of the Augustinian monastery of St. Thomas the Martyr near Buttevant (prope Bothomam) in the diocese of Cloyne (Clonen.) have granted to farm, contrary to synodal constitutions, to laymen and married clerks, (fn. 5) a number of the yearly rents, lawfully belonging to the said prior and convent, and wont to be granted to farm for a certain yearly cess, of the parish churches of Arredit and Cayle in the diocese of Ross, canonically united to the said monastery, on account of which divine worship in those churches is very much diminished and their burdens not borne. At the said petition, which added that if the said rents were granted to John for life he would pay the said cess to the present prior and the prior for the time being and the convent, and would serve the said churches in divine offices and bear the said burdens, the pope hereby orders the above three to summon the prior and convent and those to whom the said grants have been made, and others concerned, and if they find the facts to be as stated, to declare the said grants made against the said constitutions to be null and invalid, and in that event to grant to farm for life to the said John (who, having obtained by canonical collation the perpetual vicarage(s) of the parish church(es) of Donacmor and Kilscinleac in the diocese of Ross, has held possession for about two years without having himself promoted to holy orders, and has taken the fruits etc., to the value of 2 marks sterling) the said rents, value not exceeding 9 marks sterling a year, under the wonted yearly cess, to be paid by him to the prior and convent, removing the said laymen and married clerks. Wenzel's ‘An. v. to. 17 nelle rubricelle.’ A contemporary flyleaf has, in different contemporary hands, the description: ‘Primus de diversis [formis] anno sexto domini nostri domini Pii pape ii,’ the order: ‘R(ecipe) B., P. [i.e.de Varris],’ and the answering: ‘R(ubricatus) [est] per me Jo. Beyer.’ There is also the occasional quasi-contemporary ‘Quesit(us).’ A like contemporary description: ‘Primus …’ occurs, as usual, on the bottom edge of the volume. There are i.–cccxix. ff. of text.
