To Master Theodore de Leliis, a chaplain of the pope and auditor of causes of the apostolic palace. Mandate as below. The recent petition of Andrew Lyell, priest, of the diocese of St. Andrews, bachelor in decrees, contained that a dispute arose between him and Humphrey de Walance, clerk, of the said diocese, about the parish church of Newland in the diocese of Glasgow, of the patronage of laymen, to which, as being then void by the consecration of Ninian bishop of Whiteherne (Candide case), Andrew alleged that he was presented by the patron Janet (Johannetam) Dougles, lady of the place [of] Duket (sic) in the diocese of St. Andrews, to the bishop of Glasgow within the lawful time, and that provision was made to him thereof by papal authority, and that Humphrey unjustly opposed the said presentation and provision, and prevented them from taking effect, intruded himself and took possession; that the present pope, at Andrew's instance, committed the cause, notwithstanding that it had not by its nature lawfully devolved to the Roman court, to the above auditor, and that the said auditor is said to have proceeded short of a conclusion. The said petition adding that some allege that neither Andrew nor Humphrey has a right in or to the said church, the pope hereby orders the above auditor, if by the result of the suit he find that neither Andrew nor Humphrey has such right, to collate and assign the church, value not exceeding 40l. sterling, to Andrew; whether it be void as above, or by the resignation of the said bishop Ninian or of the said Andrew, or by the death of William Watson, or in any other way. To the treasurer and the precentor of Ferns and Thomas [O]Feargail, a canon of the same. Mandate (the pope having been informed by Donald Omu[r]chy, a canon of the Augustinian monastery of St. John the Evangelist, Tuam, that Thomas Odruhyn, abbot of the Augustinian monastery of St. Mary, Ferns, being under sentence of excommunication duly pronounced by papal authority, and publicly proclaimed excommunicate, has celebrated or rather profaned, more than once, masses and other divine offices in contempt of the Keys, and taken part therein, incurring irregularity; that he has dilapidated etc. the goods of the monastery and consumed them for evil and unlawful uses; that he has expelled the canons, neglected to supply them with the necessaries of life, and allowed them to wander, so that some have died without the monastery through penury and poverty and want of the necessaries of life and his negligence, and so that not one religious is at present in the monastery on account of the said Thomas, who neglects divine worship therein, and goes elsewhere for the celebration of masses, and in other ways destroys the monastery in spirituals and temporals; and that he has committed perjury, about which and divers other crimes he is greatly defamed in those parts (fn. 3) if and after Donald (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted) accuses Thomas before the above three, to summon Thomas and others concerned, and if they find the foregoing to be true, to deprive and remove Thomas, and in that event to make to Donald, if found fit, provision of the said monastery, value not exceeding 18 marks sterling; whether it become void by such deprivation, or be void by the death of Nicholas Ydouhyn (recte Ydruhyn), or by the resignation of the said Nicholas, or in any other way. To the abbot of Kelso in the diocese of St. Andrews. Mandate to collate and assign to William Forfar alias Hold, a canon of the Augustinian monastery of Jedworthe in the diocese of Glasgow, if found fit (who lately, notwithstanding his illegitimacy as the son of unmarried parents, entered the said order and made his profession, and had himself promoted to all even holy orders) the priorship of the said monastery, conventual and value not exceeding 9l. sterling, void by the death of Nicholas de Craufurd, and reserved to the pope under his late general reservation of all conventual priories. He is hereby dispensed to receive and retain it, notwithstanding the said defect etc., and to resign it when he pleases, and hold instead another benefice of the said order with or without cure, even if a priorship etc. Dignum arbitramur. To the archbishop of Tuam and the abbot of St. Michael's, Mayo, in the diocese of Tuam. Mandate, at the recent petition of abbot William and the convent of the Augustinian monastery of St. John the Evangelist, Tuam (containing that formerly a certain David Prindragas, layman, of the diocese of Tuam, gave to the said monastery in frankalmoin for ever, with consent of his future heirs, a number of lands or possessions called the quarter [of] Desgyehan (fn. 4) in the said diocese, as is said to be more fully contained in letters patent sealed with the seals of the chapter of Tuam and the said convent) if they find the foregoing to be true, to confirm and approve the said donation of Desgyehan and the other contents of the said letters etc. and their consequences, and cause the said abbot and his successors and the convent to enjoy peaceable possession of Desgyehan and all their other goods. To the abbot of the monastery of Molana (de Insula sancti Molanfid) in the diocese of Lismore, and the precentor (preceptori, recte precentori) and the treasurer of Lismore. Mandate (the pope having been informed by Dermit Oleyn, a canon of Cloyne (Clonen.), that Nicholas Hewed, (fn. 5) chancellor of Cloyne, an open and notorious fornicator, has dilapidated etc. the goods of the chancellorship and converted them to evil and unhonest uses, and has openly committed simony and perjury, about which and divers other crimes [not here expressed] he is greatly defamed in those parts) if and after Dermit, who from fear of Nicholas's power has no hope of obtaining justice in the city and diocese of Cloyne, accuses Nicholas before the above three, to summon Nicholas and others concerned, and if they find the foregoing to be true, to deprive and remove Nicholas, and in that event to collate and assign the chancellorship, a non-major dignity, value not exceeding 10 marks sterling, to Dermit, notwithstanding that he holds a canonry of the said church and the prebend of Athull’ therein, and the rectory without cure of the parcel of Kreg and the rectory without cure of the chapel of Martell, in the dioceses of Cloyne and Limerick, the value of all which does not exceed 5 marks sterling. To the bishop and the dean of Leighlin (Legenen.) and Patrick Obruyn, a canon of the same. Mandate to collate and assign to Dermit Oquiruuan, perpetual vicar of the parish church of Ynisemiacalmac in the diocese of Dublin, the deanery of Ferns, a major elective dignity with cure, value not exceeding 20 marks sterling, void by the death of Thomas Petit, and therefore reserved under the pope's late general reservation of all major dignities in cathedral churches, summoning and removing Nicholas Kethyn, priest, of the diocese of Ferns, who, under pretext of a collation and provision made to him by authority of the ordinary after the said general reservation, has unduly detained possession for more than a year but less than two years, and still detains it, and from fear of whose power Dermit has no hope of obtaining justice in the city and diocese of Ferns; notwithstanding that Dermit holds the said vicarage, value not exceeding 1l. sterling, which, as soon as he obtains the deanery, he is, as he has offered, to resign.
