Mandate (the pope having been informed by Malachy Okoncrancum, perpetual vicar of Killcruayn in the diocese of Elphin, that Thomas Okoncrenaynd, rector of Killcornyn alias Corkcomuga in the diocese of Tuam, has committed simony and dissipated etc. the goods of the said church or rectory of Killcor[n]yn) if and after Malachy accuses Thomas before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, of the patronage of laymen and value not exceeding 8 marks sterling, provided that the said lay patrons consent, to Malachy; notwithstanding that he holds the said vicarage of Collcrubayn (sic), value not exceeding 4 marks sterling, which he is to resign upon obtaining the said rectory. To the prior of All Saints without the walls of Dublin, the archdeacon of Glendalough (Glandebaten.) and Martin Nangle, a canon of Dublin. Mandate, as below. The recent petition, of Patrick Standun, priest, of the diocese of Dublin, contained that on the voidance of the perpetual vicarage of Newcastle (de Castronovo de Magronnagayn alias de Killadrynyn) in the said diocese by the death of Maurice Macingarge in the Roman court, the prioress and convent of the Augustinian monastery of St. Mary de Gratia dei in the said diocese, the ancient patrons, presented the said Patrick to the ordinary, by whom he was instituted, and that in virtue thereof he obtained possession and still holds and detains it; that afterwards Odo Odugna, clerk, of the diocese of Meath, alleging that provision had been made to him by papal authority, and that Patrick was wrongfully in possession, presented the letters of provision to the executor thereof, Thomas abbot of Ferns in the diocese of Ferns, who, proceeding to execution, inducted or ordered to be inducted Odo into possession; that Patrick therefore appealed to the apostolic see, and that the present pope committed the cause of the appeal, at Patrick's instance, to the above three. Confirmation, at the recent petition of the abbot and convent of St. Peter's, Shrewsbury (Salopie), O.S.B., in the diocese of Coventry and Lichfield, of the appropriation made thereto by William the present archbishop of York, then bishop of Coventry and Lichfield, and afterwards ratified and approved by the chapters of the said united churches, of the parish church of Nesse alias Nesse Straunge, in the said diocese; with mandate hereby to the abbots of Westminster and St. Werburgh's, Chester, and the official of Canterbury, to cause the aforesaid to be published where and when expedient and when requested by the said abbot and convent, and to cause the said appropriation to be observed, etc. The pope exemplifies: (i) the letters of the said bishop Universis sancte matris ecclesie … Quia ut accepimus, sealed with his seal and dated in his principal chapel in his manor of Haxwode (rectius Haywode) on 31 Oct. 1449, the third year of his consecration, indiction 13, the third year of pope Nicholas V, witnessed by Masters John Reedhill and Thomas Lye, canons of St. Chad's, Shrewsbury, and drawn up in the form of a notarial instrument by William Brande, clerk, of the diocese of Conventry and Lichfield, notary public by apostolic authority, and bearing his wonted sign[-manual] and name, setting forth that king Henry V proposed to found to the praise of Almighty God and St. Winifred the Virgin, whom he very greatly venerated, a chantry in the conventual church of St. Peter, Shrewsbury, for one chaplain, secular or regular, but died before he could finish his intention; but that the present king, his son and heir, has granted to Master Thomas Ludlaw, S.T.P., abbot of the said monastery and the convent thereof his licence (which the bishop recites without its date) for the appropriation of the above church of Nesse Stra[u]nge, of their advowson and patronage, value 10l. a year, in order that the said chantry may be erected from the fruits etc. thereof for the support of a monk in addition to their hitherto wonted number, to celebrate divine offices daily at the altar of the said Virgin for the soul of the said king Henry V and the souls of his heirs and successors, notwithstanding the statute of Mortmain, and provided that a vicarage be sufficiently endowed, and the statutory portion of the fruits etc. be distributed annually to the poor. The bishop therefore, with the counsel and consent of the prior of Coventry and the dean of Lichfield, and the chapters thereof, and of the archdeacon of Salop, makes in honour of God and the said blessed Virgin, whose relics are kept in the said conventual church, the said appropriation for the said purpose, a portion being reserved for a perpetual vicar, to be presented by the abbot and convent to the bishop for institution. The bishop ordains that a monk priest of the monastery, to be called an ebdomadarius, shall celebrate or cause to be celebrated masses daily for even at the said altar for the souls of the present and of the said late king, and for the soul of the present king after his death and of his heirs and successors, and of all faithful departed: he shall receive every week 2s. from the fruits etc. of the said church through the precentor of the monastery, and the present abbot and monks shall swear, and future monks shall at their profession swear, to observe the said chantry. The bishop reserves pensions from the abbot and convent, by way of compensation, of 13s. 4d. to himself and his successors, 6s. 8d. to each of the prior and chapter of Coventry and the dean and chapter of Lichfield, and to the archdeacon of the place 3s. 4d., to be paid at Michaelmas; and provides for the yearly distribution by the abbot and convent of 6s. 8d. from the fruits of the said church to its poor parishioners within a month after every feast of the Annunciation; (ii) the approbation, retification, and confirmation of the foregoing appropriation by John Verney, dean of Lichfield and the chapter of the same, sealed with their common seal and dated in their chapter-house at Lichfield, 12 June, 1450; (iii) the like approbation by Richard, prior of Coventry, and the chapter of the same, sealed with their common seal in their chapter-house at Coventry, 13 June, 1450; (iv) the consent of Thomas Lye, archdeacon of Salop, sealed with his seal and dated at Shrewsbury, 1 July, 1450. The recent petition of Dominicus Donaldi, priest, of the diocese of Sodor, contained that he was formerly dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which, having been so promoted, he obtained the perpetual vicarage of St. Columba in Morwarne alias in Cencubwadenahe, in the diocese of Argyll alias Lismore, collated to him by authority of the ordinary; that, without having obtained any other dispensation, he resigned the said vicarage and, on the voidance of the rectory of Kilchoman (Sancti Comani) in Yle, in the said diocese of Sodor, of the patronage of the earl of Ross and lord of the Isles, by the recent resignation of Thomas de Dingweul to John de Yle earl of Ross and lord of the Isles, and admitted by John bishop of Sodor, the said earl John presented him to the said bishop, who instituted him, under pretext of which presentation and institution he took possession and has detained it for between eight and ten months, taking the fruits, although few. Seeing that in accordance with the foregoing the said presentation etc. are without force, and the said rectory being, as the pope has learned, still void as above, the pope, hereby rehabilitating Dominicus on account of the foregoing, and requiring him to resign etc., hereby orders the above three to collate and assign to him the said rectory, value not exceeding 9½l. sterling, whether void as above, or by the deprivation of Alexander Terneciolini [sic] for his faults etc., made by authority of the ordinary, or by the death of Angus Johannis not a day's journey from the Roman court, or in any other way. Mandate (the pope having been informed by Cornelius Machdavid, a monk of the Cistercian monastery of Boyle (de Buellio) in the diocese of Elphin, that Malachy Machdonnochayrmaich, abbot of the same, has dilapidated etc. the goods thereof, committed simony and perjury, and openly kept a concubine in his own house) if and after Cornelius (who lately, notwithstanding his illegitimacy as the son of unmarried parents related in the [third? ] and fourth degrees of kindred, (fn. 4) entered and made his profession as a monk of the said order and has been promoted to all even holy orders, and who from fear of Malachy's power has no hope of obtaining justice in the city and diocese of Elphin) accuses Malachy before the above two, to summon Malachy, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision to Cornelius, if found fit, of the said monastery, net value not exceeding 30 marks sterling, whether it become void by such deprivation etc., or be void by the death of Donald Ymocham or of Thady Marchdirarmade (sic), or by the resignation of Cornelius Ymochain or of the said Donald or Thady or any other, or be void in any other way. In the event of their making to him the said provision they are to casuse him to be blessed by any catholic bishop, who shall thereafter receivé from him the usual oath of fealty according to the form enclosed, and send it as soon as possible to the pope by Cornelius's letters patent sealed with Cornelius's seal.
