To the bishop of Lincoln, and the abbot of Swynshede in the diocese of Lincoln. Mandate as below. The recent petition of the prior and convent of the Benedictine priory of Spalding in the diocese of Lincoln contained that Boniface VIII appropriated and united in perpetuity to the said priory the perpetual vicarages, which the prior and convent alleged that they were holding canonically, of the parish churches of Epaldyng (rectius Spaldyng) [and] of Bescon (rectius Weston) in the said diocese, so that on the death or resignation of the then vicars the prior and convent might take possession of the said vicarages, and convert the fruits etc. to the use and support of them and of the priory, and retain the said vicarages and cause the cure of souls to be exercised by monks of the priory or by hired (fn. 2) secular priests, appointed and removed at the sole pleasure of the prior and convent. At their said petition, adding that although they have not in virtue of the said letters taken possession, and doubt whether for certain reasons the said union etc. hold good, the pope, holding the value of the said priory, which is conventual, and vicarages to be expressed by these presents, orders the above two, if they find the said letters lawful, to confirm the said union etc. and their consequences, and moreover, pro potioris cautela suffragio, to appropriate and unite the vicarages to the priory in perpetuity, so that the prior and convent may take possession, convent the fruits to the uses of themselves and of the priory and vicarages, and cause the cure of souls to be exercised as above. To the abbot of St. Mary's, Macosquin (de Clarofonte), in the diocese of Derry and Donald Ocaelty and James Oflannagan, canons of Derry. Mandate (the pope having been informed by Patrick Oharcan, clerk, of the diocese of Derry, that Matthew Macceallaych, perpetual vicar of Aluuga in the said diocese, has openly kept a concubine, incurred perjury and committed simony) if and after Patrick accuses Matthew before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 4 marks sterling, to Patrick; notwithstanding that the pope lately ordered provision to be made to him of a benefice with or without cure in the presentation etc. of the bishop and the dean and chapter etc. of Derry. To the archdeacon of Derry and Patrick Omearagayd and Peter Oduuayll, canons of the same. Mandate to collate and assign to Cornelius Machoroymriabayd, rector of Beandchor in the diocese of Derry (who was lately dispensed by papal authority, on account of illegitimacy as the son of a clerk and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he was so promoted and obtained the said rectory) the perpetual vicarage of Boychdasyach [sic] in the said diocese, value not exceeding 3 marks sterling, so long void, by the death without the Roman court of Dominicus Machcayg, that by the Lateran statutes its collation has lapsed to the apostolic see; whether it be void as above, or by the death of John Micchacg (sic) without the said court, or by the resignation of the said Dominicus or John or other, or void in any other way, and notwithstanding that he holds the said rectory, with cure and value [likewise] not exceeding 3 marks sterling. To the bishop of London. Mandate, at the petition of Thomas Kent, layman, and Joan Dounton, of his diocese, containing that formerly, desiring to marry, but being unable to do so without papal dispensation on account of an impediment of spiritual relationship because the late Isabella, the said Thomas's former wife, had been godmother at the baptism of a daughter of the said Joan and the late Thomas Dounton, her former husband, the said Thomas Kent gave a commission to a friend of his then dwelling in those parts, who had many acquaintances in the Roman court, (fn. 3) to obtain a marriage dispensation from the apostolic see by means of his friends, (fn. 4) and that after the lapse of some months the said friend alleged with assurance (fn. 5) that the said dispensation had been obtained from the said see, wherefore Thomas and Joan contracted marriage before the church and consummated it, but subsequently learned that the dispensation had not been obtained. The pope therefore orders the above bishop, after imposing on them a penance for the said excess, to dispense them to contract marriage anew, decreeing legitimate the offspring born, if any, and that to be born.
