To Thomas Brown, perpetual vicar of Fowlis (de Foul’) in the diocese of St. Andrews, bachelor of theology and canon law. Dispensation to him, who is a priest and also M.A. and a completed bachelor of theology, (fn. 5) to receive together with the said vicarage, value not exceeding 5l. sterling, any one other benefice, or if he resign that vicarage any two other benefices, with cure or otherwise incompatible, even if parish churches or perpetual vicarages or dignities, and to retain them, if parish churches or perpetual vicarages or one of each, for five years, if other incompatible benefices, for life, and to resign them, simply or for exchange, as often as he pleases. To Patrick Lochert, (fn. 6) priest, of the diocese of Glasgow, M.A. Collation and provision to him, who is by both parents of noble birth, at the petition of James king of Scots, of whom he is a chaplain and a continual member of the household, and also of Charles king of France (the pope having recently motu proprio revoked and annulled [below, Reg Vat. CCCCLVII. f. 347d] the commenda of the parish church de Carnismule alias Kirkynner in the diocese of Whiteherne, which was made by Nicholas V. to Thomas bishop of Dunkeld for life, whereby the said church is still void as at first; and the pope holding the letters of the said commenda and the true mode of voidance and the name and surname of the last rector to be expressed as if inserted and expressed in these presents (fn. 7) ) of the said church, value not exceeding 40l. sterling; whether it be void by the said revocation or annulment of the said commenda, or in any other way, and notwithstanding that he holds the chapel of Dwndonalde in the diocese of Glasgow, without cure and value not exceeding 4l. sterling; with mandate executory hereby to the bishop of Alessandria and the archdeacon and official of Whiteherne to induct him etc. Nobilitas generis, litterarum etc. (M. To the abbot of St. Columba's, Iona (de Y Insula), in the diocese of Sodor. Mandate (the pope having been informed by Angus Johannis, rector of St. Germanus's in the diocese of Sodor, that Andrew de Donnobin’, archdeacon of Sodor, has been and is a public concubinary, a notorious adulterer and a fornicator, a dilapidator of the goods of the archdeaconry, does not reside as he is bound to do, and has contemned the monition to put away the woman whom he kept as a concubine, thereby incurring sentence of excommunication and, being under the said sentence, has taken part in divine offices and celebrated them, thereby incurring irregularity, to the shame of the priestly order and the dignity of an archdeacon) if and after Angus (who was lately dispensed on account of illegitimacy, as the son of a married man of royal race and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which, having been so promoted, he obtained the rectory of Kilcolmkill in Morvern (Sancti Columbe in Moravia) in the diocese of Argyll, and was afterwards dispensed to receive and retain any other benefice with or without cure, even if a canonry and prebend or a dignity etc.) accuses Andrew before the above abbot, to summon Andrew, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said archdeaconry, a major elective dignity with cure, value not exceeding 22 marks sterling, to Angus. To Andrew, bishop of Glasgow. Faculty (the pope having learned that divers natives of Scotland have simonically taken many benefices, secular and regular, especially of the patronage of laymen, and that on account of wars, the dangers of the sea, distance, lack of means etc. they cannot go by themselves or by others to the apostolic see in order to implore and obtain opportune remedies, and therefore remain excommunicate) to him, who is about to journey to those parts by order of the pope for divers grave business, to absolve all such persons, secular and regular, enjoining penance, dispense them on account of irregularity, if any, contracted by celebrating mass and other divine offices or taking part therein, when under sentences of excommunication, or by having themselves promoted to holy orders when under the said sentences, dispense them, after temporary suspension, to minister in the said orders, rehabilitate all such persons, and make fresh collation and provision, after resignation of benefices, make composition in regard to fruits etc. wrongfully taken, and exact and receive sums thus agreed upon, and give acquittance, transmitting to the papal camera a moiety of the amounts thus exacted and received, and converting the other moiety to pious and other lawful uses, compelling by ecclesiastical censure those who oppose, without appeal, and invoking, if necessary, the aid of the secular arm.
