To the archbishop of Cashel, the bishop of Orvieto and the official of Cashel. Mandate to collate and assign to William Omulwarden alias Obrothe, clerk, of the diocese of Cashel (who was lately dispensed by papal authority, on account of illegitimacy as the son of a Cistercian monk and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and recently to receive and retain the deanery of Ossory and a canonry and the prebend of Achur therein, in the event of their being collated to him in virtue of certain papal letters, and who after the said first dispensation had himself made a clerk) a canonry of Cashel and the prebend desfynnowyr (rectius de ffynnowyr, i.e. Fynnowyr) therein, value not exceeding 12 marks sterling, void by the death without the Roman court of Thomas Omulkere; whether it be so void, or by the death of Dermit Ycormyc without the said court, or by the resignation of the said Thomas, or in any other way; notwithstanding the said defect and the fact that provision was recently ordered to be made to him by papal authority of the deanery of Ossory, which is a major elective dignity with cure, and of a canonry of the same and the prebend of Achur therein, their value not exceeding 56 marks sterling, which were to become void in certain ways [not here expressed]. (17 June.)
St. Peter's, Rome.
(f. 61d.)
To the prior of the secular and collegiate church of Inyscathid in the diocese of Killaloe (Laonien.), the treasurer of Killaloe and Thady Maccrath, a canon of the same. Mandate to collate and assign to Thomas Oscancain (rectius Oseancain) alias Scolan, dean of Limerick, a canonry of Ardfert and the prebend of Ceanard, value not exceeding 6 marks sterling, so long void, by the death without the Roman court of Philip Ohuoyna, that by the Lateran statutes their collation has lapsed to the apostolic see; although Thomas Macconcour, clerk, of the diocese of Ardfert, who is a natural son of the present bishop of Ardfert, and on account of whose inordinate influence in the city and diocese of Ardfert the said Thomas Oscancain (sic) has no hope of obtaining justice, and who is to be summoned and removed, has wrongfully detained possession for about six years after the said lapse without any canonical title or tittle of right; whether they be void as above, or be void because the natural father of the said Thomas Macconcour is bishop of Ardfert, (fn. 2) as above, or be void in any other way. Litterarum sciencia, (fn. 3) vite etc. (P. and H. Masheim. | P. xxii. Sextodecimo Kal. Augusti Anno Quarto, de Varris.) [3¼ pp.]
Id. July.
(15 July.)
St. Peter's, Rome.
(f. 83d.)
To David Ocormacayn, a canon of Killaloe (Laonien.). Mandate, as below. The pope has been informed by Cornelius Macconmara alias Conmara, clerk, of the diocese of Killaloe, that, a cause having arisen between Thady Donati and Thady M[a]cconmara, clerks, of the said diocese, about a canonry of Killaloe and the prebend of Tulach therein, both of them claiming the same, as the said Thady Macconmara still does; and the said Thady Donati having brought the latter, who was endeavouring to obtain possession, (fn. 4) before Malachy Macconmara, a canon of Killaloe, by papal delegation, the said Thady Macconmara, without licence of the apostolic see and the pope, promised Thady Donati to pay him a yearly life pension of 10s. sterling from the fruits etc. of the said canonry and prebend, if he would desist from the prosecution of the cause; that Thady Donati did so desist, and that Thady Macconmara has paid him the said pension for some years past, thereby perpetrating simony; and that the said Thady Macconmara has also alienated and dilapidated the goods of the said canonry and prebend, and is also notoriously involved in the crime of perjury. The pope therefore orders the above canon, if and after Cornelius (who was lately dispensed by papal authority, on account of illegitimacy as the son of a clerk and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, in virtue of which he had himself made a clerk) accuses Thady Macconmara before him, to summon Thady, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 10 marks sterling, to Cornelius, whom the pope hereby dispenses to receive and retain them, notwithstanding the said defect etc. Dignum arbitramur. (P. and Ernestus. | P. xx. Septimo Augusti Anno Quarto. de Varris.) [4½ pp.]

To the bishop of Killala (Aladen.). Mandate to make provision to Thady Ydubda, an Augustinian friar, in priest's orders (who has openly made his profession of the said order, is of a race of kings, and proposes, with the support of his noble and powerful kinsmen, to help the below-named monastery to recover many of its rights, possessions and goods which have been usurped by a number of powerful nobles and laymen, and wrongfully converted to their private uses) of the Augustinian monastery of St. Mary, Inishmurray, (Insula Murbayd) alias Acras, in the dioceses of Elphin and Killala, (fn. 5) value not exceeding 24 marks sterling, void at the apostolic see, and therefore ipso facto reserved, by the resignation made there to the pope of John Orachur, [now] a canon, sometime prior thereof; notwithstanding that he has made his open profession of the order of Augustinian friars. The pope hereby dispenses him to receive and exercise the cure, rule and administration, etc., notwithstanding the statutes and customs of the said monastery, but he is to wear the habit which is worn therein and conform to its regular institutes. Footnotes

  • 1. On the back of the volume is the usual modern description in Italian: ‘Calisto III. 1458. Anno 4. Lib. 1.’ The flyleaf, with the contemporary description, is gone, together with ff. i. and ii. The partially legible contemporary description survives, as usual, on the bottom edge of the volume, the extent of the injury being shown between the vertical lines; ‘Primus de p|reben|dis| vacantibus de provisionibus prelatorum de prebendis et dignitatibus vacantibus de officio tabe|llionatus de alt|aribus portatilibus|et de plenaria [remissione] anno iiii. domini nostri domini Calisti pape iii. The vol. contains ff. iii–cclxxvi. of text, some of which are blank.
  • 2. i.e. Maurice Macconcubaiar, as spelt (with a query) in Eubel, Hierarchia, II, p. 108, bishop from 1452 to the present year, when he apparently died. For the provision, dated 26 Jan., 1451–2, of Maurice [O'Connor] to the see of Ardfert, see also Cal. Papal Lett., Vol. X, p. 518.
  • 3. The academic degree of the dean of Limerick which this incipit implies, is not mentioned.
  • 4. eundem Thadeum Macconmara possessioni eorundem canonicatus et prebende tunc etiam incumbentem.
  • 5. Elphinen. et Aladen. dioc(esum).
  • 6. The house to which he belongs is not named.
  • 7. The house to which he belongs is not named.
There is the usual hesitation about this last word, which has been corrected either from ‘procures’ to ‘procuret’ (as it ought to be) or vice versa. See a similar instance of the same uncertainty in Reg. Vat. CCCCXLI, f. 277 above, p. 35, the third footnote.
  • 9. abbatem monasterii beate Marie Vallisregalis Cisterciensis ordinis Cecestrensis [sic] diocesis.
  • 10. Here with ‘procures’ at the end of the oath taking and sending clause, and not corrected to ‘procuret.’
  • 11. i.e. without the usual name in the margin.
  • 12. Here rightly with ‘procuret’ in the oath taking and sending clause, The hesitation on the part of the scribes of the Register between ‘procures’ and ‘procuret’ in these letters of the same type to bishops elect is, as already noted, very marked. Thus ‘procures,’ uncorrected, occurs six times, viz., on ff. 122r, 126d, 144r, 146r, 151r, 153d, whilst ’procuret,’ uncorrected, occurs only once, viz., on f. 156d, as already noted. On f. 132d, in a similar faculty in the case of an abbot elect, the word is again ‘procuret,’ uncorrected, and on f. 136d the word is corrected from ‘procures’ to ‘procuret,’ or vice versa, probably the former, as already noted.
