To Edmund de Santoria (rectius Stantona), clerk, of the diocese of Tuam alias Mayo. Rehabilitation etc., as below. Eugenius IV (upon its being set forth to him on behalf of the said Edmund that after he had ordered provision to be made to him of the rectory of Roba in Chera, in the diocese of Tuam alias Mayo, which is of the patronage of laymen and has cure, and had by the same letters dispensed him, who was in or about his twenty-second year, to receive and retain it, he obtained possession thereof, collated to him in virtue of the said letters, and held it for some time in virtue of the said dispensation, even after he had reached the lawful age, without having himself ordained priest and without other dispensation, and had held it for more than a year but less than two years after the lapse of the time of the said dispensation, and was still detaining it, without being so ordained, taking the fruits), by other letters rehabilitated him, ordered certain judges to collate and assign to him the said rectory after he had resigned it, and dispensed him not to be bound for seven years from the date of the said later letters, to be promoted to deacon's or priest's orders, on account of the said rectory, if he obtained it anew, whilst studying letters, even in a studium particulare, there being no university (studium generale) in those parts, and studying canon law there, provided that within a year of obtaining it he had himself ordained subdeacon [Cal. Papal Lett., IX, pp. 448, 449]. At his recent petition (containing that he obtained the said rectory in virtue of the said letters, and, without obtaining any other dispensation and without being ordained subdeacon during the said year, nor during the said seven years deacon and priest, has unlawfully detained the said rectory, but for less than eight years, taking the fruits as before) the pope hereby rehabilitates him, who is by both parents of noble birth, but requires him to resign. To James bishop of Bangor. Grant, as below. Nicholas V (upon its being set forth to him by the said bishop that Eugenius IV had granted him indult to hold in commendam with the church of Achonry (Acaden.), the fruits of which were small and were taxed in the papal camera at 33 gold ducats [cf. Cal. Papal Lett., IX, p. 288], the parish church of Hedle in the diocese of Winchester, which he was holding by papal dispensation, or, if he resigned it, any other parish church or its perpetual vicarage, and that, having resigned the said church, he had obtained that of Stokton’ in the diocese of Salisbury, value not exceeding 10 marks sterling; and its being added by him that the resources of the said churches [of Achonry and Stokton’] were insufficient for the maintenance of his state) dispensed him to receive and retainin commendam for life with the said churches of Achonry (Akaden.) (or other cathedral or metropolitan church to which he might be promoted) and Stokton’ any benefice with or without cure, even if a parish church or its perpetual vicarage, of [lay] patronage, (fn. 3) and to resign it, simply or for exchange, as often as he pleased. At his recent petition, containing that the fruits etc. of Stokton’ are worth more [than 10 marks], although not more than 10l. sterling, the pope, lest the said letters of pope Nicholas be held surreptitious, grants that they and their consequences shall hold good from the date of these presents, as if it had been expressed therein that the value of Stokton’ did not exceed 10l. sterling, and dispenses him to receive and retain in commendam such other benefice, even if a free chapel or of the patronage of laymen, together with the above churches of Bangor (or other cathedral or metropolitan church to which he may be promoted) and Stokton', and resign them, simply or for exchange, as often as he pleases, and receive and retain in commendam for life two similar or dissimilar benefices. To the prior of the priory of Burton (sic) in the diocese of York. Mandate, at the recent petition of Thomas Mason and William Mokeson, priests, of the diocese of York (containing that Thomas Chaworth, Robert Roos of Yngmanthoporp (sic), knights, and John Leek of Halon demised and delivered to the said Thomas Mason, priest, in order that he should pray for them and their predecessors and successors, (fn. 5) three messuages, eighty acres of land and sixteen acres of meadow, with their rights and appurtenances, situate in Bolthon (fn. 6) on Dearne (super Dirno), in the said diocese, which grant and donation the late Margaret, relict of John Zouche, knight, approved and ratified, she also giving and granting to the said Thomas Mason all the right which she had in the said three messuages, eighty acres of land and sixteen acres of meadow; and that moreover the late John Bakster, of Bolton on Dearne, gave and granted divers goods or possessions situate in the said diocese to the said William Mokson, in order that he should pray for the souls of the said John Bakster and his predecessors and successors, (fn. 7) to have and to hold and to possess and to levy the fruits arising therefrom as long as the said William Makson should live) to approve and confirm, after inquiry, the said donations and grants. To Thady (Tatheo) Odubayn, a Premonstratensian canon of St. John Baptist's de Cella parva, in the diocese of Annaghdown. Rehabilitation etc., as below. His recent petition contained that on the voidance by the death of Malachy Odubayn, a Premonstratensian canon, the said Thady's father and his immediate predecessor, of a certain vicarage or chaplaincy in the church of Annaghdown, wont to be assigned to secular clerks and sometimes wont to be governed by Premonstratensian canons, who believe this to be lawful to them in consequence of dispensations granted in accordance with certain privileges of that order, collation was by authority of the ordinary made thereof to him, who had obtained no dispensation, on account of illegitimacy as the son of the said Malachy, a priest expressly professed of the said order, and an unmarried woman, and that under pretext of such collation he detained it for several years, taking the fruits, and that, having been deprived and removed therefrom by the ordinary, he has resigned it. The pope therefore rehabilitates the said Thady, who has made his express profession, and who, notwithstanding the said defect, caused himself, after making the said profession, to be promoted to all, even holy orders, absolves him, as far only as regards the taking affect of these presents, from all sentences of excommunication etc., and dispenses him on account of any irregularity contracted by celebrating or taking part in masses and other divine offices whilst under the said sentences etc. Sedes apostolica, pia mater. To the prior of St. Mary's, Drumleachan, in the diocese of Kilmore (Triburnen.). Decree etc., as below. Nicholas V (upon its being set forth to him by bishop Andrew and the chapter of Kilmore that the said bishop, seeing that he was without a cathedral church and its canons, deputed and named, in an assembly of the whole of the clergy of the diocese and with their consent, the parish church of St. Felimy, Cellemor, to be the cathedral church of Kilmore (Triburnen.), instituted and created therein, in so far, however, as the wishes of the apostolic see should concur, (fn. 8) thirteen canonries for thirteen canons, who should in perpetuity be present at the divine hours by day and by night; and its being added that the said bishop and canons doubted whether the said deputation, nomination and creation held good, because it had been made without licence of the apostolic see) ordered on 5 Kal. Aug. anno 7 [1453] the above prior, after due inquiry, to confirm the said deputation [nomination] and creation and their consequences. Inasmuch as the said pope died before his letters were drawn up, the pope decrees [that they shall hold good from the said date, and] that these presents shall be sufficient proof of the said grant. To the masters, wardens, guardians and all the brethren of the confraternity or society of St. John Baptist, commonly called [the confraternity or society] of the tailors and linen armourers of the city of London, of both sexes, present and future. (fn. 9) Indult, as below. Their recent petition contained that a number of faithful departed of their society or confraternity, in which are many ecclesiastical prelates and nobles and divers other persons of both sexes in great number, founded and endowed to the honour of Almighty God and the glorious Virgin Mary and St. John Baptist a certain perpetual chapel in the church of London for the great concourse of the members of their society and the priests [celebrating] masses and other divine offices therein for [the souls of] them and the men or brethren and sisters of their confraternity (fn. 10); and that subsequently certain other members of their confraternity, considering that the members of their society and confraternity, of both sexes, had increased so much in number that the said chapel was too small to hold so many, founded and endowed a certain other perpetual chapel in the house or inn (fn. 11) of their confraternity, called ‘Tailleur halle’ within the bounds or immunity (fn. 12) of the parish church of St. Martin de Oteswiche, London, with an altar therein, for the more convenient fulfilling of the vows and devotion of the said confraternity (fn. 13); and that they desire that masses and other divine offices may be celebrated and sung therein as often as there shall be need, and also that the anniversaries of the members of their confraternity or society, present and future, may be performed at the respective times of the year according to custom. (fn. 14) The pope therefore grants indult that, as often as need be, they may cause, by their own or other priests of their choice, even of their confraternity, in whatsoever number they be, masses to be celebrated on their altars in the said chapel [in the said house or inn called] ‘Tailleur halle,’ and other divine offices, even with the ringing of bells, to be sung, and anniversaries to be performed, saving the right of the said parish church and of any other. Exemplification from the Register of Martin V, at the recent petition of Thomas Modisleghe, rector of Chyustauniton in the diocese of Exeter, of:— the letters ‘Exhibita nobis’ of the said pope, dated at the SS. Apostoli, Rome, 7 Id. Sept. anno 10 [1427] and addressed to the bishops of Alet and Exeter and the abbot of Nawenham in the diocese of Exeter, ordering them, at the recent petition of Thomas Modisleghe, rector of Chyustauniton in the diocese of Exeter, containing that formerly, in a cause brought by him, and long ventilated in the apostolic palace before divers auditors, against the prior of the Augustinian monastery of Taunten’ (sic), Richard (fn. 15) perpetual vicar of Pipminster alias Pyptem[i]nster, and Stephen Balemaneid, layman, of the diocese of Wells (about the restitution of the right of taking all the tithes of the village or hamlet called Baggebear within the bounds of the said parish of Chyustauniton, etc., as in Cal. Papal Lett., VII, p. 495). |

Mandate, after imposing penance for incest, to dispense Patrick Fytzmores, layman, and Morina Mecmachuna, of the dioceses of Ardfert and Killaloe (Laonien.), who are dwelling in the diocese of Ardfert, and who formerly, not in ignorance that they were related in the third and third and in the double fourth and in the third degrees of kindred and in the simple fourth degree of affinity, committed fornication several times [and had offspring], to marry, notwithstanding the impediments arising from the said kindred and affinity, and also the impediment of quasi-affinity (publice honestatis justicie) arising from the fact that Morina formerly contracted espousals per verba de futuro with Patrick's brother; proclaiming legitimate the offspring born, and that to be born of the marriage.
