To the archbishop of York (E[b]oracen.). Mandate, as below. The recent petition of John Preston, a canon of the Augustinian monastery of Warter (Wa[r]trie) in the diocese of York, contained that formerly, when in deacon's orders, whilst walking with a companion through certain fields near certain bushes or hedges, his companion accidentally touched a thorn which, springing back, struck John in the left eye, thereby blinding him on the spot (fn. 3); and adding that he, in ignorance of the law, seeing that he had thereby incurred no deformity on account of which in celebrating divine worship the people could be scandalized, (fn. 4) had himself promoted to the priesthood and ministered in the ministry of the altar. The pope therefore orders the above archbishop, if by inspection of the said eye he find that the deformity in it is so slight that no scandal can arise to the people therefrom, (fn. 5) to dispense John to minister in the orders which he has received and in the ministry of the altar. To Cornelius Okahalan, Thomas Ohaccagan and John Otonir, canons of Elphin. Mandate to collate and assign to Malachy Orellayd (rectius ‘Ocellayd,’ as it is also written), who is of noble birth, perpetual vicar of Archayrt in the diocese of Tuam, value not exceeding 2 marks sterling, the rectory of the same church, of the patronage [of laymen], the cure of souls belonging to which is exercised by the vicar of the church for the time being, (fn. 6) and the value of which does not exceed 4 marks sterling, so long void by the death of Malachy Otuhayd without the Roman court that by the Lateran statutes its collation has lapsed to the apostolic see. The said Malachy alleging that he cannot be decently maintained from the fruits etc. of the said vicarage, and that it and the rectory have been wont at times to be held by one man, the pope hereby, in order that he may be more decently maintained and more diligently apply himself to the exercise of the said cure, (fn. 7) dispenses him to receive the said rectory and retain it and the vicarage together for life. Mandate (the pope having been informed by John Dwulyng priest and David Conyll’ clerk, of the diocese of Kildare (Daren.), that Robert Waryn, a canon of Dublin, being under sentence of the greater excommunication and publicly proclaimed excommunicate, has celebrated masses and other divine offices in contempt of the Keys and taken part therein, to the shame of the priestly order) if and after John and David accuse him, to summon him, and if they find the above to be true, to deprive and remove him from the said canonry and from his prebend of Newcastle (de Novocastro) in Dublin, and in that event to declare and decree that the said canonry and prebend, value not exceeding 40 marks sterling, may and shall be collated and assigned by the true collator and patron to any fit person who seems good to him, and to grant him licence and faculty to do so. Confirmation, at her recent petition (containing that whereas the said Robert her husband, with whom she had contracted marriage per verba legitime de presenti, and with whom she had cohabited in the said marriage for several years, and to whom she had borne divers children, had shamelessly committed adultery with divers other women, and was treating her so cruelly that she could no longer cohabit with him without danger of her person, she, with a view to obtaining a judicial separation and the restoration of her dowry, brought him, not by papal delegation, before Edmund (fn. 11) Conyngensburgh, doctor of laws, vicar-general in spirituals of Thomas bishop of London, who has promulgated a definitive sentence in favour of her and against Robert, which has become a res judicata), of the said sentence as far as it was canonically delivered and promulgated. Relaxation, to be valid during twenty-five years only, of seven years and seven quarantines of enjoined penance to penitents who on the principal feasts of the year and the Nativity of St. John Baptist, SS. Peter and Paul and the dedication and on All Saints', the octaves of certain of them and the six days of Whitsun week, visit and give alms for the repair and restoration and conservation of the Cistercian monastery of [St. Mary], Hayles, in the diocese of Worcester, whose buildings are in great ruin and whose fruits etc. are not sufficient for the repair thereof; and of a hundred days to those who do so on the said octaves and six days. T. xx8 (sic),’ which is intended to repeat the usual modern description by Bissaiga on a flyleaf, viz. ‘Calixti iii. Secret. Lib. x. Anno i. ii. iii. Tom. xxviii.’ Inside the volume is the usual front half of the original sheepskin binding, with the contemporary description ‘Bullarum domini Jo. Cosida Secretarii’ and notes, e.g. ‘Visa B.’, ‘Secret(c)’ ‘Vidit Ph.’, etc. The ‘Rubricelle’ are headed ‘Sequuntur Rubricelle bullarum domini Calisti pape tercii, apud Cosidam Secretarium registratarum,’ above which is ‘Cosida,’ and in the margin ‘liber 28.’

  • 17. Dated briefly, ‘Datum etc. ut supra,’ i.e. as in the indult to John Beket, which immediately precedes. The paper strip which was attached in the margin has gone.
  • 18. Dated still more briefly. ‘Datum etc.’ Here again the paper strip has become detached and lost.
  • 19. Imperfect date: ‘Datum Rome apud Sanctum Petrum anno incarnacionis dominice mcccc quinquagesimo septimo [blank space] pontificatus nostri anno 3o.’
  • 20. In this case the above-mentioned small ‘o’ occurs in the margin.
