Fabriano.
(f. 146.)
To John Whelpdale, rector of Thuresbi in the diocese of Carlisle. Extension of the dispensation which the pope lately granted to him (to hold any two benefices with cure or otherwise incompatible, even if two parish churches etc., namely for five years if they were two parish churches or their perpetual vicarages, for life if not, and to resign them, simply or for exchange, as often as he pleased), so that he, who was receiver-general of Marmaduke, now bishop of Lincoln, when he was bishop of Carlisle, may hold such two parish churches or perpetual vicarages even for life; with tutiori pro cautela dispensation for the purpose. Vite etc. (Pe. de Noxeto. | xxxx. Jo. de Maniaco.) [In the margin:Aug(usti). 1½ pp. See above, p. 42.]
7 Id. Aug.
(7 Aug.)
Fabriano.
(f. 146d.)
To Richard Caunton, rector of Huskart in the diocese of St. Davids, I.U.D. Dispensation, as below. Lately, after he had been dispensed by papal authority to hold for life any two benefices with cure or otherwise incompatible, even if dignities etc. or parish churches etc., and to resign them, simply or for exchange, as often as he pleased, Eugenius IV dispensed him to hold for five years any other benefice with cure or otherwise incompatible, even if likewise a major or a principal dignity, elective and with cure, as is contained in letters of the present pope, those of pope Eugenius not having been drawn up by reason of his death. The pope now grants to him, who is a clerk of the papal camera and is still within the said five years, a prolongation of the said five years by other seven. (fn. 1) Grata devotionis obsequia. (Pe. de Noxeto. | xxx. H. Roleti. D. de Luca.) [In the margin: Aug(usti). 1½ pp.]
Ibid.
(f. 147d.)
To James, bishop of Achonry (Akaden.). Grant, as below. His recent petition contained that Eugenius IV granted him indult to retain in commendam with his said church of Achonry, whose fruits were slender and were taxed at 33 gold ducats of the camera, on account of wars etc., the parish church of Edle in the diocese of Winchester, which he was holding by papal dispensation, or, if he resigned it, any other parish church etc., in virtue of which he obtained the parish church of Stokton in the diocese of Salisbury, value not exceeding 10 marks sterling, resigning that of Elde [sic]. At his said petition, adding that the resources of the said churches [of Achonry and Stokton] are insufficient, the pope grants him indult to hold with them in commendam for life any benefice with or without cure, even if a parish church etc., or if of lay patronage, and to resign it, simply or for exchange, as often as he pleases. Personam tuam. (Pe. de Noxeto. | xxx. H. Roleti. D. de Luca.) [In the margin: Aug(usti). 1⅓ pp. See Cal. Lett., IX., p. 288.]

Lett., VIII, p. 627]. Seeing that in the letters of the last prorogation there was no mention that at the time of the granting thereof provision had been made to him by authority of the ordinary of the perpetual vicarage of Stormunstre Marschall in the diocese of Salisbury, and that he was in possession and was litigating about it, the pope grants to him (who is of noble birth and holds the said vicarage and the above church of Godford [values not stated]) and decrees that the said letters and their consequences shall hold good from the date thereof as if there had not been the said omission. Footnotes

  • 1. On the back of the volume is the usual modern label, with ‘Nicol. V.Secret. Tom. x.’ A thin sheepskin leaf (which was apparently not a part of the original binding) has ‘Bulle que remanserant Spoleti.’ and other contemporary notes. On a following folio, in the hand of Giovanni Bissaiga, is ‘Nicolai V. Secret. Tom. x.’ At the end of the volume is ‘Gaspar Blondus.’
  • 2. The date is incomplete, viz. ‘Datum Fabriani Camerinensis diocesis Anno etc. Millesimo quadringentesimo quinquagesimo [a space is left here for the day and month, and not filled] pontificatus nostri anno quarto.' The extreme limits for the missing date, defined by ‘anno 4,’ are 1450, March 19–1451, March 18. These limits are restricted by the date of place (Fabriano) to 1450, July 22—circ. Sept. 15. See Georgius, Vita Nicolai Quinti (Rome, 1742), p. 81, ad an. 1450: Pontifex ex Urbe mense Junio discederepestis metu coactus est. Fabrianum perrexit ubi …. die xxii Julii constitisseIn Umbriam deinde rediit, ac mense Octobris Assisii commorabatur. The present Register shows that on 11 June he was at Rome (f. 233), on June 28 at Spoleto (f. 154,) from 29 July to 15 September at Fabriano (ff. 226 and 260) and on 1 October at Assisi. On 30 October he was back at Rome (Reg. CCCXCV, f. 237). The date given by Pastor, Geschichte der Papste, vol. I, 1st ed., p. 331, 2nd ed., p. 357, for the pope's departure from Rome in 1450 on account of the plague is 15 July. The pope's return to Rome at the beginning of the cool season of the same year is mentioned in the 1st ed., p. 333, whilst in the 2nd ed., p. 358, a precise date is added, viz. 26 October. The two dates, of departure and return, are corrected in the 3rd and 4th edd., p. 425 note 1 and p. 427 respectively to 18 June and 25 October, the authority being given in the note as ‘Caffaro in Arch. d. Soc. Rom. IX., 600–601,’ i.e. the second of the extracts ‘Dai diari di Stefano Caffari’ given by Giuseppe Coletti in the Archivio della Società Romana di Storia Patria, Vol. IX (1886). The diary does not give the date of the pope's stay at Fabriano.
  • 3. quinquennium huiusmodi usque ad septennium inclusive a fine prefati quinquennii computandum
  • 4. The preamble Licet isaptiores is given in full, which is unusual.
  • 5. ‘Idus’ is substituted for ‘Kal.,’ which is cancelled.
  • 6. domum Actonen. (i.e. Acconen.) hospitale sancti Lazari leprosorum Jerosolimitan.
  • 7. domus de Burton hospitalis huiusmodi.
