Mandate (the pope having been informed by Rory Ograda, clerk, of the diocese of Killaloe, that Nicholas Ograda, a canon of Killaloe, has committed wilful murder (fn. 3) and, being a public and notorious fornicator, has dilapidated and alienated and uselessly consumed the possessions of his canonry and prebend of Thomgrene, and is defamed of these things in those parts) if and after Rory accuses Nicholas before the above prior, to summon Nicholas, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 12 marks sterling, to Rory. Mandate to collate and assign to Donald Macchayg, clerk, of the diocese of Limerick, a canonry of Kilfenora (Fin[a]boren.) and the prebend of Killeany in Aran (Sancti Endei in Aryn) therein, value not exceeding 1 mark of silver, void by the death without the Roman court of David Obare (fn. 4). To the abbot of St. Mary's, Abington (Woth[enia]), in the diocese of Emly. Mandate (the pope having been informed by John Macbyrgemayn, priest, of the diocese of Killaloe (Laonien.), that Philip Oguyr, a canon of Emly, priest, has committed simony and a public and notorious fornicator, has dilapidated and alienated and uselessly consumed the possessions of his canonry of Emly and prebend of Iferlaurayn (rectius Iserlaurayn) therein, and is much defamed of these things in those parts; and the pope having learned that Gilatius Orodayn formerly resigned before a notary public and witnesses the perpetual vicarage of Killmacnogaurb in the said diocese [of Killaloe]) if and after the said John (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which, having been so promoted, be obtained by canonical collation the perpetual vicarage of Killsennaynleth in the said diocese, which he afterwards resigned) accuses the said Philip before the above abbot, to summon Philip, and if he find the above to be true, to deprive and remove him, and also to admit the said resignation if he find that it was lawful, and, in the event of his making the said deprivation and admission, to collate and assign the said canonry and prebend and vicarage, value not exceeding 6 and 4 marks sterling respectively, whether the former become void by such deprivation or be void by the successive deaths of Maurice Ycograin or David Ygayr, clerks, and the latter be void by such resignation and admission or by the successive deaths of Donald Yhogayn or William Yhogaym (sic) clerks, or whether they be void in any other way. To the abbot of Dere and the prior of Fiwye, in the diocese of Aberdeen, and the precentor (cantori) of Aberdeen. Mandate, as below. The recent petition of William Lindesay, clerk, of the diocese of Dunkeld, licentiate in arts, contained that Gilbert Forstare, an acolyte and chaplain of the pope, without having obtained from the apostolic see licence to exchange his benefices, and Martin Vaus, priest, of the diocese of Aberdeen, M.A., resigned for purpose of exchange to Ingram bishop of Aberdeen their respective benefices, merely a canonry of Aberdeen and the prebend of Mortlach therein and the perpetual vicarage of a certain parish church [not here named] in the said diocese, and that the said bishop, perhaps ignorant of the pope's late reservation of all benefices, void and to be void, of all chaplains and acolytes of the pope and the apostolic see, admitted the resignations, and made collation and provision of the vicarage to Gilbert and of the canonry and prebend to Martin. Seeing that the said collation and provision of the said canonry and prebend to Martin are without force, and that they are still void and reserved in accordance with the foregoing, the pope hereby orders the above three to collate and assign to William (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, first to be promoted to all, even holy orders and hold a benefice with or without cure, and afterwards to hold another benefice, even if it were a canonry and prebend of other than a cathedral church) the said canonry and prebend, value not exceeding 12l. of old sterlings, summoning and removing the said Martin, who under pretext of the said collation and provision has unduly detained possession for more than a year, but less than two years, without other collation made to him by authority of papal letters or any other canonical tittle of right (fn. 5); whether they be void as above, or by the death of Thomas Grinlaw, or the resignation of the said Martin or in any other way. To John archbishop of Armagh and the prior of St. Mary's, Louth (de Lvvhe), in the diocese of Armagh (fn. 6). Mandate, as below. The recent petition of Patrick Olucheran, a canon of Armagh, contained that although he had, on the voidance of a canonry of Armagh and the prebend of Balicluyg therein by the resignation of the late Arthur Mackamil, made to the above archbishop and admitted by him by his ordinary authority, obtained possession of them, collated to him by papal authority, and had canonically held and possessed them for some time, as he still does, nevertheless Donald Macchassayt, priest, of the diocese of Clogher, falsely alleging that they belonged to him, hindered Patrick from possessing them in peace, wherefore Patrick appealed to the apostolic see, and obtained in the matter of the appeal letters of the present pope addressed to the above two, to the execution of which, as Patrick alleges, they have not yet prò–eeded. At the said petition, adding that some allege that neither Patrick nor Donald has a right in or to the said canonry and prebend, and seeing that they are still void as above, the pope (hereby holding all Patrick's benefices and their values and his dispensations to be expressed by these presents) orders the above two to summon Donald and others concerned, hear and terminate the cause of the appeal and the principal matter, causing their decision to be observed by ecclesiastical censure, and if by the result of the suit they find that neither Patrick nor Donald has such right, to collate and assign the canonry and prebend, value not exceeding 6 marks sterling, to Patrick. To the bishop of Durham. Mandate, as below. The recent petition of Margaret Goldale, of the diocese of York, contained that formerly William Dellrok, layman, of the said diocese, falsely alleging that she had contracted marriage with him per verba legitime de presenti, brought her, not by papal delegation, before the official of York, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of William and against her, from which she appealed to the apostolic see, obtained papal letters in the matter of the said appeal addressed to the bishop of Lichfield, and caused William to be summoned before the late Thomas Chesterfeld, canon of Lichfield, whom the late William bishop of Lichfield had commissioned to act in his stead, which Thomas, also wrongfully proceeding in the cause of the appeal, confirmed the said sentence by an unjust definitive sentence, from which she appealed to the said see but, delayed by a lawful impediment, did not prosecute the appeal within the lawful time, whilst the said official of York, in contempt of the said later appeal (of which he was not ignorant, and within the time for prosecuting which Margaret still was), proceeding to execution of the said prior sentence, excommunicated Margaret for not having obeyed it, and caused and ordered her to be publicly proclaimed excommunicate; wherefore she has petitioned the pope to commit the cause of the later appeal to a judge in those parts, and to order her to be absolved ad cautelam from the said sentence of excommunication. The pope therefore orders the above bishop, if what is put forward in regard to the said impediment is true, to summon those concerned, grant Margaret ad cautelam absolution, if and as far as is just, and after receiving from her a pledge that, if the bishop find that the said sentence of excommunication delivered against her was just, she will obey his mandates and the mandates of the church, and, taking lawful cognizance of the said later definitive sentence, to decree what is canonical, causing his decision to be observed by ecclesiastical censure.Humilibus supplicum votis. To Master Orlandus de Bonarlis, a papal chaplain and auditor. Mandate, as below. Lately, on the precentorship (cantoria) of Moray, which is a dignity with cure, and to which a certain canonry and prebend of the said church are annexed, becoming void in a certain way [not here expressed], the present pope made provision thereof to the late Richard Clephame, clerk, of the diocese of St. Andrews, who was also holding inter alia a canonry and the prebend of Kyngusy in the same church. Subsequently—on its being set forth to the pope by Christopher Pyot, a canon of Aberdeen, that although the said Richard had not obtained the said precentorship and annexed canonry and prebend (in the event of his obtaining peaceable possession of which the said canonry and prebend held by him were to become void, and were bound to be resigned by him) and did not seek to obtain them, but, in virtue of an agreement made between him and a certain adversary, contented himself with a canonry of Ross and the prebend of Logy therein, which were surrendered to him by way of compensation, and of which, canonically collated to him, as he alleged, he obtained possession, wherefore the said canonry of Moray and prebend of Kyngusy had become and were deemed to be void, although the said Richard unduly detained possession of them, without having obtained any fresh canonical titlethe pope ordered certain judges [not here expressed] to summon Richard and others concerned, and if they found the above to be true, to declare the said canonry of Moray and prebend of Kyngusy to have been and to be void as if the said Richard had obtained the said precentorship and annexed canonry and prebend, and in the event of their making such declaration, to collate and assign the said canonry and prebend of Kyngusy to the said Christopher, At the recent petition of the said Christopher containing that, the said posterior letters not having been executed, and the said Richard having died, John bishop of Moray made by his ordinary authority collation and provision to him of the said canonry and prebend of Kyngusy, as being void by the death of Richard; that a cause arose between him and William de Forbes, clerk and Richard also de Forbes, priest, of the diocese of Aberdeen, Archibald Jardyn, priest, of the diocese of Glasgow and John Wyly, precentor (cantor) of Caithness about the said canonry and prebend of Kyngusy, and was lawfully introduced by appeal (fn. 7) to the apostolic see, and that the pope, at Christopher's instance, committed the cause of the appeal and of the principal matter to the above auditor; and adding that some allege that none of the said litigants has a right in or to the said canonry and prebend of Kyngusy, the pope hereby (holding the state of the cause, and also Christopher's benefices and their values and his dispensations to be expressed by these presents) orders the above auditor, if he find by the result of the suit that none of the said litigants has such right, to collate and assign the said canonry and prebend of Kyngusy, value not exceeding 30l. sterling, to Christopher.Vite etc. (P. and Jo. de Millinis. | P. xxv.
