To the abbot of Rynlos (rectius Kynlos) in the diocese of Moray. Mandate, at the recent petition of Andrew Hagis, a monk of the priory of St. Andrew, Pulscardine (rectius Pluscardine), of the order of Val-des-Choux, in the diocese of Moray (containing that formerly, on its voidance by the deprivation and removal of the late William Brynech (rectius Brynech) (fn. 2) made by John, bishop of Moray, for his faults and demerits, the convent, to whom when there are no papal reservations the election of the prior belongs by ancient custom, unanimously elected the said Andrew, who consented to the election and had it confirmed by the said bishop by his ordinary authority, in virtue of which election and confirmation he obtained possession; that subsequently, after the said William had spontaneously and freely surrendered to the said bishop all his right in or to the priory, and the bishop had admitted the surrender by his said authority, Andrew similarly detained the priory, as he still does. Seeing that, in accordance with the aforesaid, the said election, confirmation, obtaining possession, and their consequences do not hold good, and that, as the pope has learned, the priory is still void as above; and seeing that it is reserved to the pope under his late reservation of all conventual priories, void and to be void, the pope hereby orders the above abbot to collate and assign the priory, which is conventual and elective and has cure, value not exceeding 50l. sterling, whether it be void as above, or by the resignation of the said William, or in any other way, to Andrew, inducting him into possession, after receiving from him the usual oath of fealty according to the form enclosed. To the abbot of Lindores (de Londoris) in the diocese of St. Andrews. Mandate, at the petition of James, bishop of St. Andrews, and the prioress and convent of the Cistercian monastery of Clichot (rectius Elichot), in the diocese of St. Andrews (containing that a dispute formerly arose and was going on almost continually between Thomas de Camera, then prior of the Augustinian priory of May in the said diocese, of the one part, and the then prioress of the said monastery and convent, of the other part, about the taking of certain tithes within the parish of Rynde in the said diocese, canonically united to the said priory [of May]; that at length the said prior Thomas made an agreement that the prioress and convent should pay him for (pro) the said tithes and his interest (fn. 3) 8 marks yearly of the money current for the time being in Scotland (fn. 4), which they did; that afterwards the said bishop James, to whom the said priory was on its becoming void in a certain way [not here expressed] granted in commendam by papal authority, and who so holds it, moved by compassion towards the present prioress and convent, and desiring to extinguish such litigation totally and for ever, has agreed with them and ordained that in future they and their successors shall pay to him, as long as he holds the said priory in commendam, and afterwards to the priors thereof, 10 marks of the said money (fn. 5) yearly for ever, for (pro) the tithes of sheaves of the lands and demesne of the said prioress and convent lying within the said parish, by whomsoever cultivated, and for the small predial and personal tithes of the said prioress and convent and their servants (fn. 6), as is contained in the letters of the said bishop sealed with his seal) if the above abbot find the bishop's said convention, ordinance and reduction lawful, to approve and confirm them and everything in the said letters concerning them. To William de Douglas, prior of the Premonstratensian church of Whiteherne. Indult at his own petition and that of William, earl of Douglas, for him (who is of royal race) and his successors to wear, as often as they please, in the said church and in other churches, priories, chapels and other places subject and belonging to the prior and chapter, the white mitre without gems, without prejudice to the bishop of Whiteherne. To William Man, a canon of the Augustinian priory of St. Mary, Belton (rectius Bolton), in the diocese of York. Dispensation, at his recent petition—containing that whilst he was a scholar he obtained letters of the present pope's penitentiary (penitenciarie nostre) ordering the archbishop of York to dispense him, on account of his illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and that, without the said letters having been executed (litteris ipsis execucioni minime demandatis) he, in ignorance of the law, believing that by the tenour thereof he had been dispensed, caused himself to be promoted to all holy orders and ministered therein, celebrating masses and other divine offices; and that subsequently, upon his learning that he had not been sufficiently dispensed, he abstained from such celebration—to minister in the said orders, and receive and retain any dignity or priorship, even conventual, of the said order. To the chancellor, the treasurer and the official of Argyll. Mandate—the pope having been informed by Geoffrey (Goffredus) Goffredi, perpetual vicar of St. Ferchinus's in the diocese of Argyll, that [H]erculus Sgyrmogeior (rectius Sgrymogeior), a canon of Argyll, has committed perjury and has dilapidated and uselessly consumed the possessions of his canonry of Argyll and the rectory of the [parish] church of St. Columba (Sancte [sic] Columbe) in Glassradh, in the said diocese, a prebend in the same [church of Argyll], of which canonry and prebend he has held possession for more than twelve years—if and after Geoffrey accuses Herculus before the above three, to summon Herculus, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 12l. sterling, to Geoffrey; notwithstanding that he holds the said vicarage, value not exceeding 8l. sterling. Nicolai V.’ A flyleaf has, in three different contemporary hands, ‘(R(ecipe) Her., A.’ [de Feletis.], ‘Primus de regularibus, prebendis vacantibus, beneficiis vacantibus et de prebendis et dignitatibus vacantibus [anno] iiii.' and ‘Rubricatus est.’ The like contemporary description occurs also, as usual, on the bottom edge of the volume, with the hardly legible addition of ‘domini nostri Nicolay pape quinti.’ The text comprises ff. 1–316.
