To the precentor of Ardfert, and Philip Oduynykayn and Edmund Macelygeoayd. canons of the same. Mandate—the pope having been informed by Maurice Fiezmoris (rectius Fitzmoris), clerk, of the diocese of Ardfert, that Maurice Ohwyr, canon of Ardfert, has committed simony and perjury and, a public and notorious fornicator, has dilapidated etc. and uselessly consumed the possessions of his canonry of Ardfert and prebend of Dyysietdauid (rectius Dyysertdauid) therein, and has committed divers other crimes [not here expressed] of which he is greatly defamed in those parts (fn. 2) —if and after Fitzmoris (who was lately dispensed by papal authority, notwithstanding his illegitimacy as the son of an unmarried nobleman of a great race of barons and knights and an unmarried woman, to be promoted to all, even holy orders and hold any compatible benefices, and who afterwards had himself made a clerk) accuses Ohwyr before the above three, to summon Ohwyr, and if they find the above or one of them enough for the purpose to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 3 marks sterling, to Fitzmoris; notwithstanding that the present pope has ordered provision to be made to him of the chancellorship of the said church, a non-major non-elective dignity with cure, and of the perpetual vicarage of Rynbero in the said diocese, of neither of which he is in possession, their value not exceeding 16 marks sterling, and has by the same letters dispensed him to receive and hold them together for life. To the abbot of Monasteranenagh (de Magio) and the priors of Rathgeil and Bridgetown (Ville pontis), in the dioceses of Limerick and Cloyne (Clonen.). Mandate to collate and assign to John Stak (fn. 3), canon of Limerick, (who was lately dispensed by papal authority, notwithstanding his illegitimacy as the son of a deacon and an unmarried woman, nobles, to be promoted to all, even holy orders and hold any compatible benefices of any number and kind, with or without cure, even if canonries and prebends, dignities etc., and to resign all, simply or for exchange, as often as he pleased, and all of whose benefices and their values and his dispensations the pope holds to be expressed by these presents) a canonry of the said church of Limerick and the prebend of Croch therein, of the patronage of laymen, value not exceeding 20 marks sterling, about to become void by the promotion, recently made by the present pope, of Maurice Stak, elect of Ardfert, to that church, and by his consecration which is to be administered, provided that the patrons consent. He is hereby dispensed to receive the canonry and prebend, and retain them for life together with the archdeaconry of the same church of Limerick, a non-major dignity with cure, provision of which has been made to him by papal authority, of which he is in possession, and about which he is litigating. To the archdeacon and Donald Macgillaruaid, a canon of Elphin, and the official of the same. Mandate (the pope having learned that a number of tithes, called a rectory, situate in the parishes of Killbude (rectius Killbride) and Tulac Occeonnedy and Ardsalae in the diocese of Elphin, lawfully belonging to the no longer existing community of the canons of the church of Elphin, and wont from of old to be assigned to canons of Elphin in lieu of a canonical portion or prebend, are by the negligence of the said canons at present void, and have been so long void that (fn. 4) their collation has by the Lateran Statutes lapsed to the apostolic see), to make provision to Charles Magoreacchy alias Macgillanagussean, clerk, of the said diocese, of a canonry of Elphin, in which church there is not a fixed number of canons, and, after he has been received as a canon, to collate and assign to him, for a canonical portion and prebend, the said tithes, value not exceeding 7 marks sterling. To Gyllacius Okeyt, a canon of Lismore. Collation and provision to him (whom the pope hereby absolves, as far only as regards the taking effect of these presents, from all sentences of excommunication etc. which he has incurred on account of simony, perjury or fornication, dispenses on account of irregularity, if any, contracted by celebrating masses etc. when under such sentences, and rehabilitates) of a canonry of Lismore and the prebend of Kylrossanta, a canonry of Limerick and the prebend of St. Munchins (sancti Monchini), and the perpetual vicarage with cure of Garry in the diocese of Limerick, the presentation to which vicarage belongs, when there are no papal reservations, to the abbot and convent of the Augustinian monastery of Kynasam in the diocese of Bath and Wells, value altogether not exceeding 38 marks sterling, void at the apostolic see, and therefore reserved, by the death there of Malachy Oconduib; notwithstanding that provision was lately made to him by papal authority of the deanery of Lismore, a major elective dignity with cure, of which he is in possession, to which a certain canonry and prebend are annexed, the value of the deanery and of the said annexes not exceeding 16 marks sterling, and about which deanery he is litigating in Ireland (in partibus). He is hereby specially dispensed to receive the vicarage and retain with it for life the said deanery, if he win it, notwithstanding the pope's late ordinance to the contrary [see above, p. 5), etc. Vite etc. [See above, p. 451.] |
