Appropriation in perpetuity to the episcopal mensa of St. Andrews of the parish church of Kirklyston in the diocese of St. Andrews, value not exceeding 50l. sterling, granted at the recent petition of James, bishop of St. Andrews—containing that the said parish church is situate within the barony of Kirklyston (which belongs to the episcopal mensa of St. Andrews and is not more than six miles distant from the most populous town of the realm, at which town the king of Scotland at times resides) and has a convenient manse for the bishop's residence (fn. 3) —the said appropriation to take effect on the resignation or death of the present rector, John Gray, or the said church becoming void in any other way; the appropriation lately made to the said mensa of the rectory of the parish church of Leswaid in the said diocese, value not exceeding 40l. sterling, being hereby, with the said bishop's consent, decreed to be revoked and dissolved as soon as that of Kirklyston takes effect, the collation of which church of Leswaid the pope hereby reserves to the said bishop for his life, upon its becoming void by the said dissolution and at each future voidance; with mandate executory hereby to the officials of St. Andrews, Dunkeld and Brechin. (f. 268d)		 To the dean and the precentor (cantori) and David Stewart, a canon, of Moray, Mandate to collate and assign to David Ogylvy, a canon of Aberdeen, licentiate in civil law by examination and M.A., of a race of barons by both parents, a canonry and the prebend called the succentorship of Moray, value not exceeding 30l. sterling, which became void by the resignation of Thomas, [now] bishop of Whiteherne, then a papal notary, to John, bishop of Moray or his vicar, and therefore reserved to the pope under his general reservation of all benefices of papal notaries; summoning and removing Gilbert Forestar, priest, of the diocese of Brechin, who under pretext of a collation and provision thereof, made (when they were void as above and when he was under excommunication) by the said bishop John or his vicar, has detained possession for about two years and still does so; whether they became void as above, or by the pope's promotion of the said bishop Thomas to the said see, or by his consecration, or in any other way, and notwithstanding that David holds a canonry of Aberdeen and the prebend of Crowdane and the parish church of Kilmany in the diocese of St. Andrews, value not exceeding 18l. and 40l. sterling respectively, and that the pope lately dispensed him to hold two incompatible benefices. Confirmation to him and his successors of the tithe of salmon, value not exceeding 7l. sterling a year, caught in the water of Fortht in the above diocese, from the place called Orcharthed to the place called Blakdowan Mouth in the said diocese, which belongs to the vicar of the said parish church, and which he and his predecessors for fifty years have been in peaceable possession of. The text is apparently incomplete: Cum … peticio continebat, parrochialis ecclesia de Kirklyston Sanctiandrce diocesis infra limites baronie de Kirklyston ad mensam episcopalem Sanctiandree legitime pertinentis et a cetera villas inter alias regni Scotie magis populosa in qua rex Scotie pro temporic existens suam residenciam interdum facere consuevit ultra sex miliaria non distantis consistere et mansionem accommodam pro episcopi Sanctiandree etiam pro tempore existentis residencia habere noscatur.
  • 5. Theiner has for the value of the canonry and prebend ‘quorum fructus, redditus et proventus in viginti librarum (rectius fructus, redditus et proventus triginta librurum) sterlingorum … non excedunt,’ and omits from ‘notwithstanding’ onwards, without indicating the omission.
