(f 56d.)
To John, bishop of St. Rufina's, cardinal of the holy Roman church. archbishop of Canterbury. Mandate. as below. The recent petition of William Fytell', priest. of the diocese of Norwich. contained that although he was duly presented to bishop Walter by the lay patron of the rectory of St. Michael's at Plea (ad placita) Norwich and instituted by the said bishop, and in virtue thereof obtained possession and held it for several years, nevertheless John Wygenhale, then as now the said bishop's vicar-general in spirituals, under pretext of special power from the said bishop without lawful cause and without citation etc., deprived him and made collation and provision of the said rectory. as void by such deprivation. to a certain Richard Ferror, clerk, of the said diocese, wherefore William lodged a complaint (fn. 5) before John Stokes, auditor of causes of John, archbishop of Canterbury, before whom he caused the said Richard to be cited, and before whom the cause has been proceeded with, short of a conclusion, and from whom Richard has appealed to the apostolic see; and that the present pope committed the appeal and the principal matter, at Richard's instance, to John, bishop of Penne, residing in the Roman court, who has proceeded short of a conclusion. Seeing that, as William's said petition added, he is so poor that he cannot prosecute the cause further in the said court, and that its merits can be more easily made clear in England (fn. 6) than in the said court, the pope hereby, calling up the cause to himself. orders the above bishop to summon Richard and others concerned, resume the cause, hear it further and decide it. enforcing his decision by ecclesiastical censure, without appeal. etc. Humilibus supplicum votis (Pe. de Noxeto. | xxi. A. de Veneriis. G. de Puteo.) [In the margin: Oct(obris). 2 pp.]

(17 June.)
St. Peter's, Rome.
(f. 76d.)
To Michael Coruanell(is), priest, of the diocese of Exeter, I.U.B. Rehabilitation, as below. His recent petition contained that formerly, when holding the perpetual vicarage of St. Piran (Sancti Pierani) in the diocese of Exeter, he obtained by collation of the ordinary the parish church of St. Michael. Baunton, in the said diocese, about whose lay patronage litigation had arisen, detaining the said vicarage and church for some time without papal dispensation; that afterwards, estecming that he had been sufficiently dispensed by papal authority in regard to holding two incompatible benefices, even if two parish churches or their perpetual vicarages, he resigned the said vicarage and obtained by collation of the ordinary that of All Saints, Okehampton, in the said diocese (on condition, however, that if he had not been dispensed to retain two incompatible benefices, his resignation of the said vicarage of St. Piran and his acceptance of that of All Saints should be held null), and held them together for three weeks; and that subsequently, after he had obtained the said vicarage of All Saints, the present pope dispensed him, who alleged that he was holding the said vicarage of St. Piran, to receive and hold for life with that vicarage any one other, or if he resigned it any two other benefices [with cure] or otherwise incompatible, even if two parish churches or two perpetual vicarages etc. or one of each, and to resign them. simply or for exchange, as often as he pleased [above, p. 91], whereupon, after having really resigned the vicarage of St. Piran, he has held for more than a year but less than two, in virtue of the said dispensation, the said church of St. Michael and vicarage of All Saints. At his said petition, adding that he fears lest he has incurred the penalties of Execrabilis, the pope hereby rehabilitates him, and grants and decrees that the collations made to him of the said church of St. Michael and vicarage of All Saints and the said dispensation etc. shall hold good as if the dispensation had been granted to him before he obtained as above, and as if he had not held together the said two vicarages and church. Sedes apostolica, pia mater. (—. | xxx. M. Amici. Constantinus.) [In the margin: Ja(nuarii). 14/5 pp.]

To John Pynchebek. perpetual chaplain at the altar of St. John in the chapel of St. John Baptist situate by the church of Aldermaryehirch over the Charnel (super Charnellum) in the diocese of London. S.T.B. Indult, as below. The pope has learned that the late John Export, a citizen of London, provided in his will for the hiring by his heirs and executors of a perpetual chaplain to celebrate divine offices for the souls of himself and all faithful; that he left no heirs and executors, and that his possessions were, according to the custom of England, confiscated to the royal exchequer (camere regali), to a value of about 11l. sterling over and above all reprises, and that therefore king Richard founded and endowed the above perpetual chaplaincy called a chantry, the foundation and endowment providing that the holder shall daily celebrate divine offices for the good estate of the said king and after his death for his soul, and for the soul of queen Anne, then already dead, and for the souls of their progenitors, of the said John and of all faithful. Seeing that the above John, the present holder of the chantry, desires to absent himself from time to time, for preaching and recreation, visiting his friends and for his health etc., but is bound by oath to observe the said foundation and endowment, the pope, at his petition, grants him indult for life to absent himself for a time which seems good to him, and take the fruits etc. meanwhile; provided that if he absent himself for more than six months he shall cause the chantry to be served by a sufficient chaplain, and that, wherever he be at such times of absence, he shall celebrate divine offices for the said souls. The recent petition of Henry, king of England contained that Richard, duke of York, Thomas Courtanay, earl of Devon and Edward Broke, lord of Cobham, after gathering great forces, repaired to the king's presence and submitted to him, and by the mediation of John, now bishop of St. Rufina's. then cardinal priest of St. Balbina's, and a number of the king's councillors, took a certain solemn oath, but afterwards, as the king has been informed, obtained from the pope or the pope's penitentiary letters of absolution therefrom, to the great disturbance of the estate, peace and quiet of the king and his dominions. At the said petition the pope, considering that if such letters have emanated, which he does not believe. they were against his intention. hereby revokes and annuls them. Ad fut.rei mem.
