The recent petition of William Fytell', priest. of the diocese of Norwich. contained that although he was duly presented to bishop Walter by the lay patron of the rectory of St. Michael's at Plea (ad placita) Norwich and instituted by the said bishop, and in virtue thereof obtained possession and held it for several years, nevertheless John Wygenhale, then as now the said bishop's vicar-general in spirituals, under pretext of special power from the said bishop without lawful cause and without citation etc., deprived him and made collation and provision of the said rectory. as void by such deprivation. to a certain Richard Ferror, clerk, of the said diocese, wherefore William lodged a complaint (fn. 5) before John Stokes, auditor of causes of John, archbishop of Canterbury, before whom he caused the said Richard to be cited, and before whom the cause has been proceeded with, short of a conclusion, and from whom Richard has appealed to the apostolic see; and that the present pope committed the appeal and the principal matter, at Richard's instance, to John, bishop of Penne, residing in the Roman court, who has proceeded short of a conclusion. To Michael Coruanell(is), priest, of the diocese of Exeter, I.U.B. Rehabilitation, as below. His recent petition contained that formerly, when holding the perpetual vicarage of St. Piran (Sancti Pierani) in the diocese of Exeter, he obtained by collation of the ordinary the parish church of St. Michael. Baunton, in the said diocese, about whose lay patronage litigation had arisen, detaining the said vicarage and church for some time without papal dispensation; that afterwards, estecming that he had been sufficiently dispensed by papal authority in regard to holding two incompatible benefices, even if two parish churches or their perpetual vicarages, he resigned the said vicarage and obtained by collation of the ordinary that of All Saints, Okehampton, in the said diocese (on condition, however, that if he had not been dispensed to retain two incompatible benefices, his resignation of the said vicarage of St. Piran and his acceptance of that of All Saints should be held null), and held them together for three weeks; and that subsequently, after he had obtained the said vicarage of All Saints, the present pope dispensed him, who alleged that he was holding the said vicarage of St. Piran, to receive and hold for life with that vicarage any one other, or if he resigned it any two other benefices [with cure] or otherwise incompatible, even if two parish churches or two perpetual vicarages etc. or one of each, and to resign them. simply or for exchange, as often as he pleased [above, p. 91], whereupon, after having really resigned the vicarage of St. Piran, he has held for more than a year but less than two, in virtue of the said dispensation, the said church of St. Michael and vicarage of All Saints. The recent petition of the prior and convent of the Augustinian monastery of St. Mary, Conal, in the diocese of Kildare, contained that divers princes and temporal lords gave them the patronage and presentation to divers churches, chapels and benefices; that the late Richard, bishop of Kildare and William, bishop of Leighlin, with consent of their respective chapters, granted to them in perpetuity the said and other churches and benefices in their dioceses, likewise of their patronage, in such wise that the fruits etc. thereof served for the uses of the said prior and convent, which grant by bishop William was confirmed by the late Meylerus, his successor as bishop of Leighlin; as is more fully contained in the letters of the said bishops, sealed with the seals of the said chapters, in which are the names of the said churches etc. At the said petition, adding that although they have canonically held the said churches etc. for two hundred years, they fear molestation, and that the said letters are beginning to be worn with age, the pope orders the above to inform themselves, each in his diocese. and if they find the above to be as stated, to confirm the said grants, donations etc. Apostolice nobis licet. Revocation etc., as below. The recent petition of Henry, king of England contained that Richard, duke of York, Thomas Courtanay, earl of Devon and Edward Broke, lord of Cobham, after gathering great forces, repaired to the king's presence and submitted to him, and by the mediation of John, now bishop of St. Rufina's. then cardinal priest of St. Balbina's, and a number of the king's councillors, took a certain solemn oath, but afterwards, as the king has been informed, obtained from the pope or the pope's penitentiary letters of absolution therefrom, to the great disturbance of the estate, peace and quiet of the king and his dominions. At the said petition the pope, considering that if such letters have emanated, which he does not believe. they were against his intention. hereby revokes and annuls them. Ad fut.rei mem. To Robert Sprotlay and John Baron, perpetual chaplains in the church of London. Indult. at their recent petition (containing that, on account of the chantry founded by the late John, duke of Lancaster in the said church, they are bound, in accordance with the foundation and institution thereof, to say conjointly (fn. 19) the canonical hours and other divine offices in a certain chapel appointed for them, lodge together and eat together (fn. 20), and on the principal feasts be present at the canonical hours in the choir and at processions, under pain of perjury, and that they cannot absent themselves from the said chantry for more than seven weeks, and are bound to other burdens, which, on account of the slenderness of the fruits of the chantry they cannot fulfil), for each of them to hold for life with the said chantry, which is without cure, any other benefice with or without cure, even if a canonry and prebend or a dignity, not major, in the said or a collegiate church, and to let and rent the fruits etc. thereof, even to laymen, to say the said office and hours separately (fn. 21) in the said chapel or any other place of their choice, and to absent themselves from the said chantry, without licence of the dean of the said church, as often as they please. for recreation or other lawful cause, provided that they cause the chantry to be served by another or others, and, for lawful causes, not to be present at the said feasts and processions, without incurring perjury, the pope hereby absolving them from their oath to observe the aforesaid.
